SECTION 1270.30 USER AGREEMENT


 

Section 1270.30  User Agreement

 

Prior to any dissemination of CHRI to a school district, the school district shall enter into a user agreement with the Department.  The text of the agreement (Form DSP6-418) shall be provided by the Department.

 

a)         The agreement shall require the school district to:

 

1)         Abide by Section 1, et seq., of "AN ACT in relation to criminal identification and investigation" (Ill. Rev. Stat. 1985, ch. 38, par. 206-1, et seq.) and 28 CFR 20.1, et seq., 1986;

 

2)         Limit dissemination of CHRI to statutorily authorized parties as authorized by Sections 10-21.9(b) and 34-18.5(b) of The School Code;

 

3)         Retain CHRI only for the period necessary to complete the hiring decisions described in Sections 10.21.9 and 34-18.5 of The School Code and to comply with any other laws and regulations relating to the retention of employee and applicant records, after which CHRI may either be returned to the Department or destroyed;

 

4)         Provide the Department, for the purpose of periodic audits, access to records relating to CHRI utilization;

 

5)         Provide security for requested CHRI to ensure against unauthorized utilization and dissemination;

 

6)         Ensure that those employees with access to CHRI are familiar with the laws, rules and regulations relating to CHRI.

 

b)         The agreement shall require the Department to:

 

1)         Upon a statutorily authorized request, search its files for CHRI;

 

2)         Provide the user school district with copies of those portions of an applicant's CHRI files indicating convictions for enumerated offenses.

 

c)         The agreement shall provide for suspension of service upon violation of the terms of the user agreement.
