HOUSE RESOLUTION 60 Offered by Representative Pugh: WHEREAS, The Illinois House of Representatives takes notice that judicial proceedings have established that at least nine innocent persons have been convicted of murder and sentenced to death under Illinois' current death penalty law; and WHEREAS, Serious allegations of wrongdoing have led to grand jury indictments charging local police and prosecutors with official misconduct and perjury in connection with the investigation and prosecution of one such capital case; and
HOUSE OF REPRESENTATIVES 295 WHEREAS, The federal racketeering conviction of one Illinois State court judge, proven to have taken a bribe in at least one capital case and possibly others, has led to a new trial for the defendants in one such capital case and to review by the United States Supreme Court in another; and WHEREAS, Statistical evidence demonstrates that racial bias continues to have an impact on which defendants are chosen to face capital charges, and which defendants ultimately receive a sentence of death; and WHEREAS, Illinois' death row has the highest percentage of minority inmates in the United States; and WHEREAS, The income and resources of the defendant also play a significant role in the death sentencing process, as evidenced by the disproportionate number of poor and low-income persons on death row; and WHEREAS, Illinois has consistently failed to provide adequate resources to ensure satisfactory representation for defendants in capital cases, resulting in the inability of overburdened, often unskilled, attorneys to mount an adequate defense; and WHEREAS, With each new revelation of error, misconduct and discrimination the death penalty process continues to erode public confidence in our criminal justice system; and WHEREAS, Corruption and prejudice employed in the administration of justice undermines the very foundation upon which the United States of America was built; and WHEREAS, In order for the State to protect its moral and ethical integrity, the State must ensure a justice system which is impartial and uncorrupted; and WHEREAS, The execution of an innocent person by the People of the State of Illinois would be a grave and irreversible injustice; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the House of Representatives does establish an independent, non-partisan Commission on the death penalty to study all aspects of the death penalty as currently administered in Illinois; and be it further RESOLVED, That the Commission on the Death Penalty, which shall serve without compensation, be comprised of 10 members; 4 appointed by the Speaker of the House of Representatives; 4 appointed by the House Minority Leader; the State Appellate Defender or his designee; and the Attorney General of Illinois or his designee; and be it further RESOLVED, That the Commission on the Death Penalty hold public hearings and call before it witnesses to testify on issues relevant to the administration of the death penalty in Illinois; and be it further RESOLVED, That the Commission shall report its findings and recommendations regarding the death penalty, including remedies for any deficiencies found by the Commission, to the Governor, members of the House of Representatives, and the Illinois Supreme Court, by June 30, 1999; and be it further RESOLVED, That the Illinois House of Representatives urges the Governor to exercise his authority to grant temporary reprieves under Article V, Section 12 of the Illinois Constitution, and institute an immediate halt to executions in the State of Illinois, and that such a moratorium on executions remain in effect until the Commission has issued its findings and recommendations, and until any necessary reforms in the administration of the death penalty are implemented; and be it further RESOLVED, That the House of Representatives calls upon the Supreme Court of Illinois to exercise its judicial discretion under

HOUSE RESOLUTION 61 Offered by Representative Gash: WHEREAS, Many State agencies (as defined in Section 1-7 of the Illinois State Auditing Act) collect fees, charges, and tolls that are for the purpose of offsetting the costs of providing services; and WHEREAS, those fees, charges, and tolls should substantially reflect actual costs; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY- FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the Auditor General is directed to study all fees, charges, and tolls charged by State agencies for services and to compare the cost of the services provided with the income from fees, charges, and tolls; and be it further RESOLVED, that the Auditor General shall report its findings to the General Assembly no later than January 10, 2000; and be it further RESOLVED, that suitable copies of this resolution be delivered to the Auditor General and to the directors of all State agencies. HOUSE RESOLUTION 72 Offered by Representative Mitchell: WHEREAS, The issue of obscenity is a problem of public concern within the State of Illinois; and WHEREAS, The Internet, computer networks, and the dissemination of pornographic material is a growing problem in the State of Illinois; and WHEREAS, Many Illinois citizens are concerned about the regulation of obscenity, especially now that obscenity affects computer interlibrary transfers; and WHEREAS, The State of Illinois has 102 counties; each county has a different and diverse composite of religious, ethnic, and economic interests among its citizens; and WHEREAS, It is the responsibility of the Illinois General Assembly to take into consideration this diversity; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that there is created the Obscenity Regulation Commission consisting of 6 members: 3 to be appointed by the Speaker of the House of Representatives, and 3 to be appointed by the Minority Leader of the House of Representatives to study and report on the pervasiveness and availability of obscenity to minors and the ability of local communities to deal with siting issues in the counties of the State of Illinois; members of the Commission shall serve without compensation but shall be reimbursed for their reasonable and necessary expenses from funds appropriated for that purpose; and be it further RESOLVED, That the Commission shall meet initially at the call of

I, Sec. 25 new) SECTION 25. UNIVERSAL HEALTH CARE COVERAGE Health care is an essential safeguard of human life and dignity, and there is an obligation for the State of Illinois to ensure that every person is able to realize this fundamental right. On or before May 31, 2002, the General Assembly by law shall enact a plan for universal health care coverage that permits everyone in Illinois to obtain decent health care on a regular basis. SCHEDULE This Constitutional Amendment takes effect upon approval by the electors of this State.
