WHEREAS, The members of the Illinois House of Representatives
wish to congratulate Father Norbert J. Zawistanowicz on the joyful
celebration of his fiftieth year of service to the priesthood; and
WHEREAS, Father Norbert J. Zawistanowicz was born on June 5, 1923
in Moline, Illinois and attended St. Wenceslaus Grammar School,
Quigley Preparatory Seminary, and St. Mary of the Lake Seminary,
where he was ordained to the priesthood on May 7, 1949; and
WHEREAS, Father Norbert J. Zawistanowicz received his first
assignment serving as an associate pastor at Immaculate Heart of Mary
Parish, where he served for 17 years including acting as temporary
pastor during the illness of Father Piwka; during this time he also
served as Bishop Wycislo's Master of Ceremonies, until Father Norbert
moved to St. Joseph Parish in 1966; and
WHEREAS, From 1973 to 1975 he was associate pastor at St.
Turibius, from 1975 to 1977 he was associate pastor at St. Richard's,
and from 1977 until his retirement 16 years later in 1993, he served
as the sixth pastor of Immaculate Heart of Mary; and
WHEREAS, Father Norbert J. Zawistanowicz has also served with the
Priests' Senate, the Matrimonial Tribunal, and the Board of Catholic
Cemeteries; while serving with the Personnel Board of the Priests'
Senate he compiled a demographic study on personnel, church
attendance, and activities within the Archdiocese of Chicago; he also
established the Office of Research & Planning at the request of
Cardinal Cody; and
WHEREAS, Father Norbert J. Zawistanowicz currently resides, and
continues an active role in services, at Our Lady of Victory Parish;
he continues as a Board Member of Catholic Cemeteries, represents
senior priests on the Presbyterial Council, and pursues his interests
in reading, travel, and tutoring; and
WHEREAS, Father Norbert J. Zawistanowicz is ardently committed to
the sanctity of life, having said Mass at the Women's Center, and
continues to lead prayer outside of abortion clinics on the first and
third Saturdays each month; therefore, be it

Phillips has shown why such an award fits her so well; and
WHEREAS, Alice Phillips has raised three lovely daughters; in
addition, she is the proud grandmother of four grandchildren; and
WHEREAS, Alice Phillips is a giver: from the Girl Scouts, the
P.T.A., and the Wheaton North Boosters, to the dinner parties where
she is known as "Martha Stewart of Illinois", Alice Phillips shows
why she deserves this award; and

was given a high honor when she was elected Speaker of the Third

WHEREAS, The U. S. Census taken in 1990 indicated that the State
of Illinois had 16,588 people identifying their ethnicity as Native
American/Alaskan Native and now, the most current population
estimates, adjusted for census undercounting and population
increases, indicate the Native American/Alaskan Native population in
Illinois at approximately 24,000 people; and
WHEREAS, The State of Illinois currently has only one specific
healthcare agency in the entire State to serve this population and
that one agency has never received State funding or assistance for
specific Native American/Alaskan Native health issues; and
WHEREAS, Studies indicate that Native American/Alaskan Natives,
in various cases, have higher rates of disabilities than the general
population, that they experience visual impairments 3 times more
frequently than the general population, and that Fetal Alcohol
Syndrome (FAS) affects a much higher number of Native American babies
than the general population; and
WHEREAS, Native American/Alaskan Native children face much
greater risks of involuntary separation from their families through
foster care and adoption; and
WHEREAS, The high school dropout rate is higher among Native
American/Alaskan Natives than for other ethnic minority groups; and
WHEREAS, The State of Illinois lags behind other states in
recognizing the specific needs of the Native American/Alaskan Native
population; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY- FIRST
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Governor
and the Secretary of the Illinois Department of Human Services to
survey the needs of the Native American/Alaskan Native population in
the State of Illinois and report back to the General Assembly no
later than December 31, 1999 with the results of that survey
including a plan of action to address the survey's findings; and be
it further
RESOLVED, That we urge the Governor and the Directors of the
Illinois Department on Aging, the Illinois Department of Children and
Family Services, the Illinois Department of Public Aid, and the
Illinois Department of Public Health to also survey the needs of the
Native American/Alaskan Native population in the State of Illinois

State Superintendent of Education, and an extensive cross-section of
Native Americans from various backgrounds, to assist in the creation
of the survey and to ensure that any agreed plan of action is
conducive to Native American/Alaskan Native people in the State of

WHEREAS, H.R. 2 is a bill that was introduced this year in the
U.S. House of Representatives to send more dollars to the classroom
and for certain other purposes; and
WHEREAS, In this bill, Congress urges the Department of
Education, states, and local educational agencies to work together to
ensure that not less than 95% of all funds appropriated for
elementary and secondary education programs administered by the
Department of Education is spent for children in their classrooms;
the bill also provides for an educational flexibility program under
which the Secretary of Education allows a State educational entity to
waive statutory and regulatory requirements for the State educational
agency or any local education agency or school and provides for the
modification of arbitrage rebate rules applicable to bonds used to
finance public schools; therefore be it

WHEREAS, One of the fundamental cornerstones of the United
States' domestic policy should include the encouragement and support
of the institution of marriage; and
WHEREAS, The existing provisions of the federal Internal Revenue
Code undermine this policy due to the disproportionate difference in
the individual income tax rates and the standard deduction between
married taxpayers and single taxpayers, known as the marriage
penalty; and
WHEREAS, The marriage penalty imposes a heavy financial burden on
married taxpayers and places additional restraints on the ability of
these taxpayers to fund family expenditures; and
WHEREAS, In light of the federal revenue surplus, the elimination
of the marriage penalty provides an immediate means of granting
relief to a large segment of the taxpaying population; and
WHEREAS, Members of the U.S. House of Representatives of the 1st
Session of the 106th Congress have introduced H.R. 6 creating the
Marriage Tax Elimination Act of 1999 to eliminate the
disproportionate burdens placed on married taxpayers under the
federal Internal Revenue Code; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST

Illinois region to permit convenient transfers among all 3 transit
systems so that employment centers and other key destinations
throughout the region are more accessible by public transit; and
WHEREAS, The ability of passengers to transfer between transit
systems would increase the number of riders; would increase farebox
revenues; would reduce traffic congestion on the region's roads;
would reduce air pollution; and would bring workers to jobs in local
communities where new interchanges would be created; therefore, be it

Chicago Transit Authority interchanges at locations where Chicago
Transit Authority rapid transit rail lines and Metra commuter rail
lines are in close proximity to one another; plan for the addition of
Pace buses and vans at Metra and Chicago Transit Authority stations
to reach key employer destinations, including for night-time shifts;
plan for the addition of signs, maps, and schedules at stations,
platforms, and bus stops to inform riders of opportunities for
transfers among the transit systems; and plan for a universal fare
card to enable riders to transfer conveniently among all 3 transit
systems; and be it further
RESOLVED, That in conducting an analysis to determine potential
ridership, travel destinations, hours of operation, or any other
matters, the Regional Transportation Authority should consult with
members of the public through focus groups or public hearings or
both; and be it further
RESOLVED, That by December 31, 1999, the Regional Transportation
Authority is requested to submit a report to the General Assembly on
findings and recommendations to implement the purposes of this

AMENDMENT NO. 1. Amend Senate Bill 463 on page 1, lines 2 and 6,

Sec. 10. Definitions. In this Act, and except to the extent that
any of the following words or phrases is specifically qualified by
its context:
"Commission" means the Illinois Student Assistance Commission
created by this Act.
"Enrollment" means the establishment and maintenance of an
individual's status as a student in an institution of higher
learning, regardless of the terms used at the institution to describe
that status.
"Approved high school" means any public high school located in
this State; and any high school, located in this State or elsewhere
(whether designated as a high school, secondary school, academy,
preparatory school, or otherwise) which in the judgment of the State
Superintendent of Education provides a course of instruction at the
secondary level and maintains standards of instruction substantially
equivalent to those of the public high schools located in this State.
"Institution of higher learning", "qualified institution", or
"institution" means an educational organization located in this State
which
(1) provides at least an organized 2 year program of
collegiate grade in the liberal arts or sciences, or both,
directly applicable toward the attainment of a baccalaureate
degree or a program in health education directly applicable
toward the attainment of a certificate, diploma, or an associate
degree;
(2) either is
(A) operated by this State, or
(B) operated publicly or privately, not for profit, or
(C) operated for profit, provided such for profit
organization
(i) offers degree programs which have been
approved by the Board of Higher Education for a minimum
of 3 years under the Academic Degree Act, and

(ii) enrolls a majority of its students in such
degree programs, and
(iii) maintains an accredited status with the
Commission on Institutions of Higher Education of the
North Central Association of Colleges and Schools;
(3) in the judgment of the Commission meets standards

operated by this State; and
(4) if so required by the Commission, uses the State as its
primary guarantor of student loans made under the federal Higher
Education Act of 1965.
For otherwise eligible educational organizations which provide
academic programs for incarcerated students, the terms "institution
of higher learning", "qualified institutions", and "institution"
shall specifically exclude academic programs for incarcerated
students.
"Academic Year" means a 12 month period of time, normally but not
exclusively, from September 1 of any year through August 31 of the
ensuing year.
"Full-time student" means any undergraduate student enrolled in
12 or more semester or quarter hours of credit courses in any given
semester or quarter or in the equivalent number of units of
registration as determined by the Commission.
"Part-time student" means any undergraduate student, other than a
full-time student, enrolled in 6 or more semester or quarter hours of
credit courses in any given semester or quarter or in the equivalent
number of units of registration as determined by the Commission.
Beginning with fiscal year 1999, the Commission may, on a program by
program basis, expand this definition of "part-time student" to
include students who enroll in less than 6 semester or quarter hours
of credit courses in any given semester or quarter.

"payment of taxes, fees, or other charges already due, or which may
thereafter become due from that company until such excess or excesses
have been fully refunded, or upon a written request from the
authorized company, the Director shall provide at his discretion, to
make a cash refund within 120 days after receipt of the written
request if all necessary information has been filed with the
Department in order for it to perform an audit of the annual return
for the year in which the overpayment occurred or within 120 days
after the date the Department receives all the necessary information
to perform such audit. The Director shall not provide a cash refund
if there are insufficient funds in the Insurance Premium Tax Refund
Fund to provide a cash refund, if the amount of the overpayment is
less than $100, or if the amount of the overpayment can be fully
offset against the taxpayer's estimated liability for the year
following the year of the cash refund request. Any cash refund shall
be paid from the Insurance Premium Tax Refund Fund, a special fund
hereby created in the State treasury.
(b) Beginning January 1, 2000 and thereafter, the Department
shall deposit a percentage of the amounts collected under Sections
409, 444, and 444.1 of this Code into the Insurance Premium Tax
Refund Fund. The percentage deposited into the Insurance Premium Tax
Refund Fund shall be the annual percentage. The annual percentage
shall be calculated as a fraction, the numerator of which shall be
the amount of cash refunds approved by the Director for payment and
paid during the preceding calendar year as a result of overpayment of
tax liability under Sections 409, 444, and 444.1 of this Code and the
denominator of which shall be the amounts collected pursuant to

Sections 409, 444, and 444.1 of this Code during the preceding
calendar year. However, if there were no cash refunds paid in a
preceding calendar year, the Department shall deposit 5% of the
amount collected in that preceding calendar year pursuant to Sections
409, 444, and 444.1 of this Code into the Insurance Premium Tax
Refund Fund instead of an amount calculated by using the annual
percentage.
(c) Beginning July 1, 1999, moneys in the Insurance Premium Tax
Refund Fund shall be expended exclusively for the purpose of paying
cash refunds resulting from overpayment of tax liability under
Sections 409, 444, and 444.1 of this Code as determined by the
Director pursuant to subsection 1(a) of this Section. Cash refunds
made in accordance with this Section may be made from the Insurance
Premium Tax Refund Fund only to the extent that amounts have been
deposited and retained in the Insurance Premium Tax Refund Fund.
(d) This Section shall constitute an irrevocable and continuing
appropriation from the Insurance Premium Tax Refund Fund for the
purpose of paying cash refunds pursuant to the provisions of this
Section."; and

on page 4 by inserting immediately below line 20 the following:
"Section 99. Effective date. This Act takes effect upon

(a) The following communications are exempt from the provisions
of this Act:
(1) Any stockholder communication such as an annual report
or interim financial report, proxy material, a registration
statement, a securities prospectus, a registration, a property
report, or other material required to be delivered to a
prospective purchaser by an agency of any state or the federal
government.
(2) Any oral or written statement disseminated by a
developer to broadcast or print media, other than paid
advertising or promotional material, regarding plans for the
acquisition or development of timeshare property. However, any
rebroadcast or any other dissemination of such oral statements to
a prospective purchaser by a seller in any manner, or any
distribution of copies of newspaper magazine articles or press
releases, or any other dissemination of such written statements
to a prospective purchaser by a seller in any manner, shall
constitute an advertisement.
(3) Any advertisement or promotion in any medium to the
general public if such advertisement or promotion clearly states
that it is not an offer in any jurisdiction in which any
applicable registration requirements have not been fully
satisfied.
(4) Any audio, written, or visual publication or material
relating to the availability of any accommodations for transient
rental, so long as a sales presentation is not a term or
condition of the availability of such accommodations and so long
as the failure of any transient renter to take a tour of a
timeshare property or attend a sales presentation does not result
in any reduction in the level of services which would otherwise
be available to such transient renter.
(b) The following communications are exempt from the provisions
of this Act, provided they are delivered to any person who has
previously executed a contract for the purchase of or is an existing
owner of a timeshare interest in a timeshare plan:
(1) Any communication addressed to and relating to the
account of any person who has previously executed a contract for
the sale or purchase of a timeshare period in a timeshare plan to
which the communication relates.
(2) Any audio, written, or visual publication or material
relating to an exchange company or exchange program provided to
an existing member of that exchange company or exchange program.
(3) Any communication by a developer to encourage a person
who has previously acquired a timeshare interest from the

on page 10, by deleting lines 1 through 24; and
on page 36, by replacing lines 24 through 26 with the following:

interest under this Act shall be voidable by the purchaser, without";
and
on page 37, line 10, by replacing "any party" with "a purchaser"; and

Representative Fritchey moved to suspend the provisions of Rule
25 on SENATE BILLS 876 and 877, suspending the posting requirements.
