    Amends the Election Code. Requires election authorities to publish notice of certain public referenda not more than 40 (rather than 30) days before the question is to be submitted to the voters.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
512-5 as follows:
 
6    (10 ILCS 5/12-5)  (from Ch. 46, par. 12-5)
7    Sec. 12-5. Notice for public questions. For all elections
8held after July 1, 1999, notice of public questions shall be
9required only as set forth in this Section or as set forth in
10Section 17-3 or 19-3 of the School Code. Not more than 40 30
11days nor less than 10 days before the date of a regular
12election at which a public question is to be submitted to the
13voters of a political or governmental subdivision, and at least
1420 days before an emergency referendum, the election authority
15shall publish notice of the referendum. The notice shall be
16published once in a local, community newspaper having general
17circulation in the political or governmental subdivision. The
18notice shall also be given at least 10 days before the date of
19the election by posting a copy of the notice at the principal
20office of the election authority. The local election official
21shall also post a copy of the notice at the principal office of
22the political or governmental subdivision, or if there is no
23principal office at the building in which the governing body of

1the political or governmental subdivision held its first
2meeting of the calendar year in which the referendum is being
3held. The election authority and the political or governmental
4subdivision may, but are not required to, post the notice
5electronically on their World Wide Web pages. The notice, which
6shall appear over the name or title of the election authority,
7shall be substantially in the following form:
8        NOTICE IS HEREBY GIVEN that at the election to be held
9    on (insert day of the week), (insert date of election), the
10    following proposition will be submitted to the voters of
11    (name of political or governmental subdivision):
12    (insert the public question as it will appear on the
13    ballot)
14        The polls at the election will be open at 6:00 o'clock
15    A.M. and will continue to be open until 7:00 o'clock P.M.
16    of that day.
17        Dated (date of notice)
18        (Name or title of the election authority)
19The notice shall also include any additional information
20required by the statute authorizing the public question. The
21notice may include an explanation, in neutral and plain
22language, of the question and its purposes supplied by the
23governing body of the political or governmental subdivision to
24whose voters the question is to be submitted. The notice shall
25set forth the precincts and polling places at which the
26referendum will be conducted only in the case of emergency
