AMENDMENT TO HOUSE BILL 512

2    AMENDMENT NO. ______. Amend House Bill 512, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Election Code is amended by changing
6Section 12-5 as follows:
 
7    (10 ILCS 5/12-5)  (from Ch. 46, par. 12-5)
8    Sec. 12-5. Notice for public questions. For all elections
9held after July 1, 1999, notice of public questions shall be
10required only as set forth in this Section or as set forth in
11Section 17-3 or 19-3 of the School Code. Not more than 60 30
12days nor less than 10 days before the date of a regular
13election at which a public question is to be submitted to the
14voters of a political or governmental subdivision, and at least
1520 days before an emergency referendum, the election authority
16shall publish notice of the referendum. The notice shall be

1published once in a local, community newspaper having general
2circulation in the political or governmental subdivision. The
3notice shall also be given at least 10 days before the date of
4the election by posting a copy of the notice at the principal
5office of the election authority. The local election official
6shall also post a copy of the notice at the principal office of
7the political or governmental subdivision, or if there is no
8principal office at the building in which the governing body of
9the political or governmental subdivision held its first
10meeting of the calendar year in which the referendum is being
11held. The election authority and the political or governmental
12subdivision may, but are not required to, post the notice
13electronically on their World Wide Web pages. The notice, which
14shall appear over the name or title of the election authority,
15shall be substantially in the following form:
16        NOTICE IS HEREBY GIVEN that at the election to be held
17    on (insert day of the week), (insert date of election), the
18    following proposition will be submitted to the voters of
19    (name of political or governmental subdivision):
20    (insert the public question as it will appear on the
21    ballot)
22        The polls at the election will be open at 6:00 o'clock
23    A.M. and will continue to be open until 7:00 o'clock P.M.
24    of that day.
25        Dated (date of notice)
26        (Name or title of the election authority)

1The notice shall also include any additional information
2required by the statute authorizing the public question. The
3notice may include an explanation, in neutral and plain
4language, of the question and its purposes supplied by the
5governing body of the political or governmental subdivision to
6whose voters the question is to be submitted. The notice shall
7set forth the precincts and polling places at which the
8referendum will be conducted only in the case of emergency
9referenda.
