SYNOPSIS AS INTRODUCED:
 
410 ILCS 625/3  from Ch. 56 1/2, par. 333

    Amends the Food Handling Regulation Enforcement Act. Provides that all food service establishments shall have at least one certified food service sanitation manager who has undergone training that follows nationally recognized industry standards for allergen safety and allergen awareness available on the premises at all times that the food service establishment is in operation. Provides that all individuals seeking food service sanitation manager certification or food service sanitation manager recertification shall undergo training that follows nationally recognized industry standards for allergen safety and allergen awareness. Provides that any costs for the allergen safety and allergen awareness training shall be borne by the individual seeking the training. Effective immediately.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Food Handling Regulation Enforcement Act is
5amended by changing Section 3 as follows:
 
6    (410 ILCS 625/3)  (from Ch. 56 1/2, par. 333)
7    Sec. 3. Each food service establishment shall be under the
8operational supervision of a certified food service sanitation
9manager in accordance with rules promulgated under this Act.
10    By July 1, 1990, the Director of the Department of Public
11Health in accordance with this Act, shall promulgate rules for
12the education, examination, and certification of food service
13establishment managers and instructors of the food service
14sanitation manager certification education programs. Beginning
15July 1, 2014, any individual seeking a food service sanitation
16manager certificate or a food service sanitation manager
17instructor certificate must complete a minimum of 8 hours of
18Department-approved training, inclusive of the examination,
19and receive a passing score on the examination set by the
20certification exam provider accredited under standards
21developed and adopted by the Conference for Food Protection or
22its successor organization. A food service sanitation manager
23certificate and a food service sanitation manager instructor

1certificate shall be valid for 5 years, unless revoked by the
2Department of Public Health, and shall not be transferable from
3the individual to whom it was issued. Beginning July 1, 2014,
4recertification for food service sanitation manager
5certification shall be accomplished by presenting evidence of
6completion of 8 hours of Department-approved training,
7inclusive of the examination, and having received a passing
8score on the examination set by the certification exam provider
9accredited under standards developed and adopted by the
10Conference for Food Protection or its successor organization.
11In addition to the other training requirements of this Section,
12all individuals seeking food service sanitation manager
13certification or food service sanitation manager
14recertification shall undergo training that follows nationally
15recognized industry standards for allergen safety and allergen
16awareness. Any costs for the allergen safety and allergen
17awareness training shall be borne by the individual seeking the
18training. All food service establishments shall have at least
19one certified food service sanitation manager trained in
20allergen safety and allergen awareness available at all times
21that the food service establishment is in operation.
22    For purposes of certification and recertification for food
23service sanitation manager certification, the Department shall
24accept only training approved by the Department and
25certification exams accredited under standards developed and
26adopted by the Conference for Food Protection or its successor.

1The Department shall charge a fee of $35 for each new and
2renewed food service sanitation manager certificate and $10 for
3each replacement certificate. All fees collected under this
4Section shall be deposited into the Food and Drug Safety Fund.
5    Any fee received by the Department under this Section that
6is submitted for the renewal of an expired food service
7sanitation manager certificate may be returned by the Director
8after recording the receipt of the fee and the reason for its
9return.
10    The Department shall award an Illinois certificate to
11anyone presenting a valid certificate issued by another state,
12so long as the holder of the certificate provides proof of
13having passed an examination accredited under standards
14developed and adopted by the Conference for Food Protection or
15its successor. The $35 issuance fee applies. The reciprocal
16Illinois certificate shall expire on the same date as the
17presented certificate. On or before the expiration date, the
18holder must have met the Illinois recertification requirements
19in order to be reissued an Illinois certificate. Reciprocity is
20only for individuals who have moved to or begun working in
21Illinois in the 6 months prior to applying for reciprocity. Any
22individual presenting an out-of-state certificate may do so
23only once.

25    Section 99. Effective date. This Act takes effect upon
26becoming law.
