SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-413 new

    Amends the Department of Central Management Services Law. Requires the Director of Central Management Services to direct the relocation to Sangamon County of all State employment positions under the Personnel Code that are not required by their nature or function to be located in a specific geographic area. Requires the Director to direct all new State employment positions which may be created under the Personnel Code, and which are not required by their nature or function to be located in a specific geographic area, to be located in Sangamon County. Requires the Director to determine a geographic location for each State employment position and, if it is other than Sangamon County, the reason for it to be in that geographic location. Provides that in determining whether to locate or relocate a State employment position to Sangamon County, the Director shall consult the Director of any affected State agency as to whether the nature or function of a position requires it to be located in a specific geographic area of the State, and if no such geographic necessity exists, that position shall be located or relocated to Sangamon County. Provides that the rights of employees and the State and its agencies under the Personnel Code and applicable collective bargaining agreements with respect to the relocation of current State employee position holders shall not be affected. Provides that the provisions regarding location or relocation of a position to Sangamon County shall apply only to State employment positions that become vacant or are created on or after the effective date of this amendatory Act. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-413 as follows:
 
7    (20 ILCS 405/405-413 new)
8    Sec. 405-413. Geographic consolidation of State employment
9positions.
10    (a) Notwithstanding any other law to the contrary, the
11Director of Central Management Services, working in
12consultation with the Director of any affected State agency,
13shall direct the relocation to Sangamon County of all State
14employment positions under the Personnel Code that are not
15required by their nature or function to be located in a
16specific geographic area.
17    (b) Notwithstanding any other law to the contrary, the
18Director of Central Management Services, working in
19consultation with the Director of any affected State agency,
20shall direct all new State employment positions which may be
21created under the Personnel Code, and which are not required by
22their nature or function to be located in a specific geographic
23area, to be located in Sangamon County.

1    (c) The Director shall determine a geographic location for
2each State employment position and, if it is other than
3Sangamon County, the reason for it to be in that geographic
4location. In determining whether to locate or relocate a State
5employment position to Sangamon County, the Director shall

7the nature or function of a position requires it to be located
8in a specific geographic area of the State. If no such
9geographic necessity exists, that position shall be located or
10relocated to Sangamon County.
11    (d) The rights of employees and the State and its agencies
12under the Personnel Code and applicable collective bargaining
13agreements with respect to the relocation of current State
14employee position holders shall not be affected by the
15provisions of this Section. The provisions of this Section
16regarding location or relocation of a position to Sangamon
17County shall apply only to State employment positions that
18become vacant or are created on or after the effective date of
19this amendatory Act of the 100th General Assembly.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
