AMENDMENT TO HOUSE BILL 4295

2    AMENDMENT NO. ______. Amend House Bill 4295 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-413 as follows:
 
7    (20 ILCS 405/405-413 new)
8    Sec. 405-413. Geographic consolidation of State employment
9positions.
10    (a) Notwithstanding any other law to the contrary, the
11Director of Central Management Services, working in
12consultation with the Director of any affected State agency,
13shall direct the relocation to Sangamon County of all State
14employment positions under the Personnel Code that are not
15required by their nature or function to be located in a
16specific geographic area.

1    (b) Notwithstanding any other law to the contrary, the
2Director of Central Management Services, working in
3consultation with the Director of any affected State agency,
4shall direct all new State employment positions which may be
5created under the Personnel Code, and which are not required by
6their nature or function to be located in a specific geographic
7area, to be located in Sangamon County.
8    (c) The Director shall determine a geographic location for
9each State employment position and, if it is other than
10Sangamon County, the reason for it to be in that geographic
11location. In determining whether to locate or relocate a State
12employment position to Sangamon County, the Director shall
13consult the Director of any affected State agency as to whether
14the nature or function of a position requires it to be located
15in a specific geographic area of the State. If no such
16geographic necessity exists, that position shall be located or
17relocated to Sangamon County.
18    (d) The rights of employees and the State and its agencies
19under the Personnel Code and applicable collective bargaining
20agreements with respect to the relocation of current State
21employee position holders shall not be affected by the
22provisions of this Section. The provisions of this Section
23regarding location or relocation of a position to Sangamon
24County shall apply only to State employment positions that
25become vacant or are created on or after the effective date of
26this amendatory Act of the 100th General Assembly.

1    (e) The provisions of this Section do not apply to the
2Statewide offices of any executive branch constitutional
3officer or any member of the General Assembly.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
