    Amends the Illinois Income Tax Act. Creates an income tax checkoff for donations to the Pediatric and Rare Disease in Children Research Fund. Amends the State Finance Act to create the Pediatric and Rare Disease in Children Research Fund. Provides that moneys deposited into the Pediatric and Rare Disease in Children Research Fund shall be used by the Department of Public Health for the purpose of making grants to organizations in Illinois that conduct research, investigation, and experimentation that results in a better understanding of pediatric and rare diseases in children and an ultimate cure or treatment option. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. This Act may be referred to as Jonny's Law.
 
5    Section 5. The State Finance Act is amended by adding
6Sections 5.886 and 6z-105 as follows:

8    Sec. 5.886. The Pediatric and Rare Disease in Children
9Research Fund.

11    Sec. 6z-105. The Pediatric and Rare Disease in Children
12Research Fund; creation. The Pediatric and Rare Disease in
13Children Research Fund is created as a special fund in the
14State treasury. Moneys deposited into the Fund shall be used by
15the Department of Public Health for the purpose of making
16grants to organizations in Illinois that conduct research,
17investigation, and experimentation that results in a better
18understanding of pediatric and rare diseases in children and an
19ultimate cure or treatment option. For the purposes of this
20Section, the term "research" includes, without limitation,
21expenditures to develop and advance the understanding,

1techniques, and modalities effective in early detection,
2prevention, cure, screening, and treatment of pediatric and
3rare diseases in children. The grant funds may not be used for
4institutional, organizational, or community-based overhead or
5other indirect costs. The Department may use moneys in the
6Pediatric and Rare Disease in Children Research Fund to provide
7additional funding to existing programs that are funded by the
8Childhood Cancer Research Fund.
 
9    Section 5. The Illinois Income Tax Act is amended by adding
10Section 507III as follows:

12    Sec. 507III. The Pediatric and Rare Disease in Children
13Research Fund checkoff. For taxable years ending on or after
14December 31, 2018, the Department must print on its standard
15individual income tax form a provision (i) indicating that if
16the taxpayer wishes to contribute to the Pediatric and Rare
17Disease in Children Research Fund, he or she may do so by
18stating the amount of the contribution (not less than $1) on
19the return and (ii) stating that the contribution will reduce
20the taxpayer's refund or increase the amount of payment to
21accompany the return. Failure to remit any amount of increased
22payment shall reduce the contribution accordingly. This
23Section does not apply to any amended return.
 
24    Section 99. Effective date. This Act takes effect upon
