SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1413.5 new

    Amends the Illinois Vehicle Code. Provides that a person operating a commercial motor vehicle with a gross weight of 10,001 or more pounds upon a highway of this State shall remove any ice and snow from the hood, roof, and sides of the vehicle that poses a threat to the safety of other persons or property on the highway during the operation of the vehicle. Exempts from this requirement a person operating a vehicle during a period of snow, sleet, or freezing rain if the period began and continued during the vehicle's operation; a person operating a vehicle when the vehicle is parked; a person operating an authorized emergency vehicle or highway maintenance vehicle; a person operating a State fleet vehicle while on official State business; or a person operating a school bus. Makes a violation a petty offense punishable by a fine of not more than $25 for the first offense and not more than $50 for a second or subsequent offense.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1413.5 as follows:
 
6    (625 ILCS 5/11-1413.5 new)
7    Sec. 11-1413.5. Ice and snow removal from vehicle.
8    (a) A person operating a commercial motor vehicle with a
9gross vehicle weight of 10,001 or more pounds upon a highway of
10this State shall remove any ice and snow from the hood, roof,
11and sides of the vehicle that poses a threat to the safety of
12other persons or property on the highway during operation of
13the vehicle.
14    (b) This Section shall not apply to:
15        (1) a person operating a vehicle during a period of
16    snow, sleet, or freezing rain if the period began and
17    continued during the vehicle operation;
18        (2) a person operating a vehicle when the vehicle is
19    parked;
20        (3) a person operating an authorized emergency vehicle
21    or a highway maintenance vehicle;
22        (4) a person operating a State fleet vehicle while on
23    official State business; or

1        (5) a person operating a school bus.
2    (c) A person who violates this Section shall be guilty of a
3petty offense and shall be fined not more than $25 for a first
4offense and not more than $50 for a second or subsequent
5offense.
