SYNOPSIS AS INTRODUCED:

    Amends the Illinois Municipal Code. Provides that the City of Chicago shall make grants from moneys transferred to the City under the Chicago Casino Development Authority Act (currently introduced in Senate Bill 7) to municipalities that meet specified eligibility requirements. Provides that a municipality that is part of a group of municipalities that jointly act for the purpose of obtaining or treating water is not eligible for a grant. Limits the amount of grants to $3,000,000 annually. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Division 88.1 of Article 11 as follows:

DIVISION 88.1. WATER INFRASTRUCTURE GRANTS

9    Sec. 11-88.1-5. Definitions. For the purpose of this
10Division:
11    "Authority" means the Chicago Casino Development Authority
12created by the Chicago Casino Development Authority Act.
13    "City" means the City of Chicago.
14    "Infrastructure" means roads, access roads, streets,
15bridges, sidewalks, water and sewer line extensions, water
16distribution and purification facilities, stormwater drainage
17and retention facilities, gas and electric utility line
18extensions, public buildings or structures, or other
19improvements that are essential to the development of a
20publicly administered project.
21    "Water infrastructure" means infrastructure whose primary
22purpose is to pump, divert, transport, store, treat, or deliver

1water, including any costs associated with planning,
2construction, obtaining easements, and debt service payments.
3    "Municipality" does not include a municipality that is part
4of a group of municipalities that jointly act, either by
5intergovernmental agreement or any other form of joint action,
6for the purpose of obtaining or treating water.

8    Sec. 11-88.1-10. Water infrastructure grants.
9    (a) Notwithstanding Public Act 99-506, from the moneys
10transferred to the City under Section 1-50 of the Chicago
11Casino Development Authority Act, the City shall make grants to
12eligible municipalities in Illinois that submit an application
13which complies with subsection (d) of this Section for the
14purpose of funding water infrastructure projects in an amount
15not to exceed $3,000,000 annually.
16    (b) Beginning on the effective date of Senate Bill 7 of the
17100th General Assembly, a municipality is eligible to receive
18grants under subsection (a) of this Section if it pays more
19than $7,000,000 annually to purchase water at wholesale from an
20out-of-state supplier on the effective date of this amendatory
21Act of the 100th General Assembly and has not directly or
22indirectly purchased or otherwise received water from the City
23during the 2 years prior to the effective date of this
24amendatory Act of the 100th General Assembly and, at the time
25it submits a grant application, it (i) purchases or otherwise

1receives at least 75% of its water from the City, and (ii) does
2not contain a riverboat or casino within its borders.
3    (c) Notwithstanding subsection (b) of this Section,
4beginning 2 years following the effective date of Senate Bill 7
5of the 100th General Assembly, a municipality is eligible to
6receive grants under subsection (a) of this Section if it pays
7more than $7,000,000 annually to purchase water at wholesale
8from an out-of-state supplier on the effective date of this
9amendatory Act of the 100th General Assembly and had not
10directly or indirectly purchased or otherwise received water
11from the City during the 2 years prior to the effective date of
12this amendatory Act of the 100th General Assembly and, at the
13time it submits a grant application, it does not contain a
14riverboat or casino within its borders.
15    (d) An application to the City by an eligible municipality
16shall include the following provisions:
17        (1) the name, address, mayor or village president, and
18    general description of the applicant municipality,
19    including information sufficient to establish that the
20    applicant is eligible to receive grants pursuant to
21    subsection (b) or subsection (c) of this Section;
22        (2) a general description of the water infrastructure
23    program, project, or use for which grant funding is
24    requested;
25        (3) such plans, equipment lists, and other documents as
26    may be required to show the type, structure, and general

1    character of the water infrastructure program, project, or
2    use for which grant funding is requested;
3        (4) cost estimates of developing, constructing,
4    operating, or completing the water infrastructure program,
5    project, or use for which grant funding is requested; and
6        (5) a program of proposed expenditures for the grant
7    funds.
8    (e) Subject to the provisions of this Section, the mayor of
9the City or his designee may establish any rules or procedures
10necessary to administer the water infrastructure grants issued
11pursuant to this Section.
12    (f) The City of Chicago shall not make grants from moneys
13received under the Chicago Casino Development Authority Act in
14a manner inconsistent with this Division. This Section is a
15limitation under subsection (i) of Section 6 of Article VII of
16the Illinois Constitution on the concurrent exercise by home
17rule units of powers and functions exercised by the State.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law, except that this Act does not take effect at all
20unless Senate Bill 7 of the 100th General Assembly becomes law.
