Amends the Code of Criminal Procedure of 1963. Provides that a firearm may not be seized by the court unless: (1) the person is subject to revocation and seizure under the Firearm Owners Identification Card Act; (2) the person subject to a firearms restraining order under the Firearms Restraining Order Act; (3) the firearm is required for evidentiary purposes; or (4) the firearm is subject to seizure as otherwise authorized by State or federal law.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Code of Criminal Procedure of 1963 is |
5 | | amended by adding Article 124C as follows: |

7 | | ARTICLE 124C. FIREARM SEIZURE |
8 | | (725 ILCS 5/124C-5 new) |
9 | | Sec. 124C-5. Firearm seizure. A firearm may not be seized |
10 | | by the court unless: |
11 | | (1) the person is subject to revocation and seizure under |
12 | | Section 8 of the Firearm Owners Identification Card Act; |
13 | | (2) the person subject to a firearms restraining order |
14 | | under the Firearms Restraining Order Act; |
15 | | (3) the firearm is required for evidentiary purposes; or |
16 | | (4) the firearm is subject to seizure as otherwise |
17 | | authorized by State or federal law.
