AMENDMENT TO HOUSE BILL 3969

2    AMENDMENT NO. ______. Amend House Bill 3969 on page 1, by
3inserting after line 16 the following:
4    "Soft restraints may be used for transporting youth under
5the care or custody of the Department only in the following 2
6limited circumstances: (i) if, based on a youth's mental health
7needs, a psychiatrist orders the use of restraints for
8transporting a youth under the care or custody of the
9Department; or (ii) if a court orders the use of restraints for
10transporting a youth under the care or custody of the
11Department. Further, even in those 2 limited circumstances, the
12use of soft restraints is not permitted unless there is a
13written recommendation by the Department's Chief Deputy
14Director, Clinical and Child Services and written approval by
15the Department's Chief Deputy Director.".
