Amends the Fox Waterway Agency Act. Provides that a person shall not operate a boat or watercraft that exceeds 40 feet in length on the Fox Waterway, with the exception of boats or watercraft that: (i) are used for dredging, construction, lake maintenance, or similar activities; (ii) carry passengers for hire; (iii) are restaurants as defined in the Food Handling Regulation Enforcement Act; or (iv) are riverboats as defined in the Riverboat Gambling Act.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Fox Waterway Agency Act is amended by adding |
| 5 | | Section 7.13 as follows:
|
| 6 | | (615 ILCS 90/7.13 new) |
| 7 | | Sec. 7.13. Boat length. A person shall not operate a boat |
| 8 | | or watercraft that is more than 40 feet in length on the |
| 9 | | waterway. This Section does not apply to boats or watercraft |
| 10 | | that: (i) are used exclusively for dredging, construction, lake |
| 11 | | maintenance, or similar activities; (ii) carry passengers for |
| 12 | | hire; (iii) are restaurants as defined in the Food Handling |
| 13 | | Regulation Enforcement Act; or (iv) are riverboats as defined |
| 14 | | in the Riverboat Gambling Act.
