1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Toll Bridge Act is amended by changing
5Section 7 as follows:
 
6    (605 ILCS 115/7)  (from Ch. 137, par. 7)
7    Sec. 7. Toll rates; electronic toll collection.
8    (a) The county board shall fix the rates of toll, and may
9from time to time, alter and change the same, including by
10establishing a toll rate schedule, setting a maximum toll rate
11that may be adjusted from time to time, or by establishing
12another toll rate structure, and in case of the neglect of the
13owner of the bridge to keep the same in proper repair and safe
14for the crossing of persons and property, may prohibit the
15taking of toll.
16    (b) Notwithstanding any law to the contrary, the county
17board may enter into an agreement establishing a toll rate
18schedule for a period not to exceed 99 years. This amendatory
19Act of the 101st General Assembly is declarative of existing
20law and shall be given retroactive effect.
21    (c) Except as regarding toll bridges or as otherwise
22provided by law, nothing in Public Act 101-398 this amendatory
23Act of the 101st General Assembly shall be construed to

1authorize a county, municipality, local government, or private
2operator to impose a toll upon any public road, street, or
3highway; nor shall any provision of Public Act 101-398 this
4amendatory Act of the 101st General Assembly be construed to
5authorize, pursuant to an intergovernmental agreement or
6otherwise, the imposition of any toll upon any public road,
7street, or highway.
8    (d) The General Assembly finds that electronic toll
9collection systems in Illinois should be standardized to
10promote safety, efficiency, and traveler convenience. If
11electronic toll collection is used on such bridge, the county
12shall cause the configuration of the electronic toll collection
13system to be compatible with the electronic toll collection
14system used by the Illinois State Toll Highway Authority. The
15municipality or private operator may enter into an agreement
16with the Illinois State Toll Highway Authority to provide for
17such compatibility or to have the Authority provide electronic
18toll collection or toll violation enforcement services. Any
19toll bridges in Winnebago County that are in operation and
20collecting tolls on the effective date of this amendatory Act
21of the 97th General Assembly are exempt from the provisions of
22the Act.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.
