SYNOPSIS AS INTRODUCED:
 
410 ILCS 635/5.1  from Ch. 56 1/2, par. 2205.1

    Amends the Grade A Pasteurized Milk and Milk Products Act. Removes language requiring the Department of Public Health to charge specific fees and instead directs the Department to determine an application fee for permits by rule. Provides that a permit issued by the Department is required prior to the operation of any milk plant, receiving station, transfer station, cleaning and sanitizing facility, milk hauler sampler, milk tank truck, or certified pasteurizer sealer. Requires the Department to determine and assess a late fee. Effective January 1, 2021.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Grade A Pasteurized Milk and Milk Products
5Act is amended by changing Section 5.1 as follows:
 
6    (410 ILCS 635/5.1)  (from Ch. 56 1/2, par. 2205.1)
7    Sec. 5.1. (a) (Blank). The Department shall charge a fee of
8$100 for each permit issued to a milk plant; $50 for each
9permit issued to a receiving station, transfer station, or
10cleaning and sanitizing facility; $25 for each permit issued to
11a milk hauler-sampler; $25 for each permit issued for a milk
12tank truck; and $100 for each certified pasteurizer sealer. In
13addition to such fees, the Department shall assess a late fee
14if an application for renewal of a permit is received after the
15expiration date of the existing permit. The late fee shall be
16$50 for a permit issued to a milk plant; $25 for a permit
17issued to a receiving station, transfer station, or cleaning
18and sanitizing facility; and $15 for a permit issued to a milk
19hauler-sampler.
20    (a-5) A permit issued by the Department is required prior
21to the operation of any milk plant, receiving station, transfer
22station, cleaning and sanitizing facility, milk hauler
23sampler, milk tank truck, or certified pasteurizer sealer. The

1operator of the facility shall file an application for a permit
2with the Department that shall be accompanied by the requisite
3fee, as determined by the Department by rule. In addition to
4the fee, the Department shall determine and assess a late fee
5if an application for renewal of a permit is received after the
6expiration of an existing permit.
7    (b) All permit fees charged under this Section shall be
8deposited into the Food and Drug Safety Fund.

10    Section 99. Effective date. This Act takes effect January
