2 | WHEREAS, Background checks through the National Instant | ||||||
3 | Criminal Background Check System are a prerequisite and | ||||||
4 | requirement of acquiring and possessing firearms and | ||||||
5 | ammunition; and
| ||||||
6 | WHEREAS, Background checks are meant to ensure that people | ||||||
7 | who are legally prohibited from owning, acquiring, or | ||||||
8 | possessing firearms, such as criminals, mentally unstable | ||||||
9 | individuals, or other persons enumerated in Section 8 of the | ||||||
10 | Firearm Owners Identification Card Act are unable to do so; and
| ||||||
11 | WHEREAS, Firearm Owners Identification Card background | ||||||
12 | check information and the National Instant Criminal Background | ||||||
13 | Check System are only as good as the information submitted by | ||||||
14 | the courts and law enforcement; and
| ||||||
15 | WHEREAS, The Firearm Owners Identification Card Act | ||||||
16 | requires the courts and the Department of State Police to fully | ||||||
17 | comply with the requirements for reporting data submitted to | ||||||
18 | the National Instant Criminal Background Check System; and
| ||||||
19 | WHEREAS, It is the duty of the Department of State Police | ||||||
20 | to revoke and seize a Firearm Owners Identification Card from a | ||||||
21 | person prohibited from possessing firearms or ammunition, as |

1 | well as to ensure that such persons no longer possess any | ||||||
2 | firearms or ammunition; therefore, be it
| ||||||
3 | RESOLVED, BY THE SENATE OF THE ONE HUNDRED FIRST GENERAL | ||||||
4 | ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES | ||||||
5 | CONCURRING HEREIN, that the Auditor General shall conduct a | ||||||
6 | performance audit of the Department of State Police's | ||||||
7 | administration of the Firearm Owners Identification Card Act; | ||||||
8 | and be it further
| ||||||
9 | RESOLVED, That the Auditor General shall review, among | ||||||
10 | other things, information reported to the Department of State | ||||||
11 | Police by clerks of the circuit court and municipal courts | ||||||
12 | under the Firearm Owners Identification Card Act, the database | ||||||
13 | utilized by the Department of State Police in reporting | ||||||
14 | information to the National Instant Criminal Background Check | ||||||
15 | System, the method of reporting any revocations to the National | ||||||
16 | Instant Criminal Background Check System, and the method of | ||||||
17 | ensuring that a person who had a Firearm Owners Identification | ||||||
18 | Card revoked is no longer in possession of a firearm or | ||||||
19 | ammunition; and be it further | ||||||
20 | RESOLVED, That the Department of State Police and any other | ||||||
21 | State agency, entity, or person that may have information | ||||||
22 | relevant to this audit cooperate fully and promptly with the | ||||||
23 | Auditor General's office in its conduct; and be it further |

1 | RESOLVED, That the Auditor General commence this audit as | ||||||
2 | soon as possible and, upon completion, distribute a report in | ||||||
3 | accordance with Section 3-14 of the Illinois State Auditing | ||||||
4 | Act.
