SYNOPSIS AS INTRODUCED:

430 ILCS 65/13.2  from Ch. 38, par. 83-13.2

    Amends the Firearm Owners Identification Card Act. Provides that the cost of a new or renewed Firearm Owner's Identification Card shall be $10 plus applicable processing fees. Provides that the cost of a corrected, lost, destroyed, or stolen Card shall be $5, plus applicable processing fees. Provides that the fees deposited into the State Police Firearm Services Fund shall exclude fees collected for payment processing.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Firearm Owners Identification Card Act is
5amended by changing Sections 5 and 13.2 as follows:
 
6    (430 ILCS 65/5)  (from Ch. 38, par. 83-5)
7    Sec. 5. Application and renewal.
8    (a) The Department of State Police shall either approve or
9deny all applications within 30 days from the date they are
10received, except as provided in subsection (b) of this
11Section, and every applicant found qualified under Section 8
12of this Act by the Department shall be entitled to a Firearm
13Owner's Identification Card upon the payment of a $10 fee,
14plus applicable processing fees. Any applicant who is an
15active duty member of the Armed Forces of the United States, a
16member of the Illinois National Guard, or a member of the
17Reserve Forces of the United States is exempt from the
18application fee. $6 of each fee derived from the issuance of
19Firearm Owner's Identification Cards, or renewals thereof,
20shall be deposited in the Wildlife and Fish Fund in the State
21Treasury; $1 of the fee shall be deposited in the State Police
22Services Fund and $3 of the fee shall be deposited in the State
23Police Firearm Services Fund.

1    (b) Renewal applications shall be approved or denied
2within 60 business days, provided the applicant submitted his
3or her renewal application prior to the expiration of his or
4her Firearm Owner's Identification Card. If a renewal
5application has been submitted prior to the expiration date of
6the applicant's Firearm Owner's Identification Card, the
7Firearm Owner's Identification Card shall remain valid while
8the Department processes the application, unless the person is
9subject to or becomes subject to revocation under this Act.
10The cost for a renewal application shall be $10, plus
11applicable processing fees, which shall be deposited into the
12State Police Firearm Services Fund, other than the fees
13collected for payment processing.

16    Sec. 13.2. Renewal; name or address change; replacement
17card. The Department of State Police shall, 60 days prior to
18the expiration of a Firearm Owner's Identification Card,
19forward by first class mail to each person whose card is to
20expire a notification of the expiration of the card and
21instructions for renewal. It is the obligation of the holder
22of a Firearm Owner's Identification Card to notify the
23Department of State Police of any address change since the
24issuance of the Firearm Owner's Identification Card. Whenever
25any person moves from the residence address named on his or her

1card, the person shall within 21 calendar days thereafter
2notify in a form and manner prescribed by the Department of his
3or her old and new residence addresses and the card number held
4by him or her. Any person whose legal name has changed from the
5name on the card that he or she has been previously issued must
6apply for a corrected card within 30 calendar days after the
7change. The cost for a corrected card shall be $5, plus
8applicable processing fees. The cost for replacement of a card
9which has been lost, destroyed, or stolen shall be $5, plus
10applicable processing fees, if the loss, destruction, or theft
11of the card is reported to the Department of State Police. The
12fees collected under this Section shall be deposited into the
13State Police Firearm Services Fund, other than those collected
14for payment processing.
