SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/2-3.196 new

    Amends the School Code. Requires the State Board of Education to establish and administer a program in which the State Board shall issue a voucher to the parent or guardian of a student, upon request of the parent or guardian, if: (1) the student was enrolled in a school district for a particular school year; (2) during that school year, the school board decided not to provide an option for full-time, in-person instruction at school as the primary method of instruction to students; and (3) the parent or guardian withdrew the student from enrollment in the district because the school board decided not to provide an option for full-time, in-person instruction. Sets forth provisions concerning the voucher amount and its use. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
52-3.196 as follows:
 
6    (105 ILCS 5/2-3.196 new)
7    Sec. 2-3.196. Voucher for substituted educational setting.
8    (a) In this Section, "substituted educational setting"
9includes, but is not limited to, a nonpublic school or a home
10school.
11    (b) The State Board of Education shall establish and
12administer a program in which the State Board shall issue a
13voucher to the parent or guardian of a student, upon request of
14the parent or guardian, if all of the following conditions are
15met:
16        (1) The student was enrolled in a school district for
17    a particular school year.
18        (2) During that school year, the school board decided
19    not to provide an option for full-time, in-person
20    instruction at school as the primary method of instruction
21    to students.
22        (3) The parent or guardian withdrew the student from
23    enrollment in the district because the school board

1    decided not to provide an option for full-time, in-person
2    instruction under paragraph (2).
3    (c) A voucher issued under this Section shall be in an
4amount equal to the per pupil amount distributed to the school
5district for the school year under Section 18-18.15 and
6Article 14, if the student qualifies for services under
7Article 14, prorated based on the length of time the student
8was enrolled in the district during the school year. The
9voucher shall be used to reimburse the parent or guardian for
10the costs incurred by the parent or guardian to provide the
11student with in-person instruction in a substituted
12educational setting.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
