AMENDMENT TO HOUSE BILL 1911

2     AMENDMENT NO. ______. Amend House Bill 1911 on page 5, by
3 replacing lines 3 through 14 with the following:
4         "(B) Whenever the Director is of the opinion that
5     imminent danger exists in the working conditions of any
6     public employee in this State, which condition may
7     reasonably be expected to cause death or serious physical
8     harm immediately or before the imminence of such danger can
9     be eliminated through the enforcement procedures otherwise
10     provided by this Act and the Health and Safety Act, the
11     Director may file a complaint in the circuit court for
12     appropriate relief against an employer and employee,
13     including an order that may require such steps to be taken
14     as may be necessary to abate, avoid, correct, or remove the
15     imminent danger and prohibit the employment or presence of
16     any individual in locations or under conditions where such
17     imminent danger exists, except those individuals whose
18     presence is necessary to abate, avoid, correct, or remove

1     the imminent danger or to maintain the capacity of a
2     continuous process operation to assume normal operations
3     without a complete cessation of operations, or where a
4     cessation of operations is necessary to permit the
5     cessation to be accomplished in a safe and orderly manner
6     directing the employer or employee to cease and desist from
7     the practice creating the imminent danger and to obtain
8     immediate abatement of the hazard."; and
 
9 on page 34, line 11, by replacing "via" with "in"; and
 
10 on page 42, by replacing lines 8 through 21 with the following:
11     "(b) If at any time the Occupational Safety and Health
12 Administration Hazard Communication standard at 29 CFR
13 1910.1200 is repealed or revoked, the Director of Labor shall
14 adopt a rule setting forth a determination that this Act should
15 be reviewed and reinstated in order to protect the health and
16 safety of Illinois' public sector workers. On the date such a
17 rule is adopted, this Act shall again become operative.".
