AMENDMENT TO SENATE BILL 2750

2     AMENDMENT NO. ______. Amend Senate Bill 2750 by replacing
3 the everything after the enacting clause with the following:
 
4     "Section 5. The State Finance Act is amended by adding
5 Section 5.708 as follows:
 
6     (30 ILCS 105/5.708 new)
7     Sec. 5.708. The Maritime and Underwater Rescue Teams Fund.
 
8     Section 10. The Boat Registration and Safety Act is amended
9 by changing Sections 3-2 and 10-1 as follows:
 
10     (625 ILCS 45/3-2)  (from Ch. 95 1/2, par. 313-2)
11     Sec. 3-2. Identification number application. The owner of
12 each watercraft requiring numbering by this State shall file an
13 application for number with the Department on forms approved by
14 it. The application shall be signed by the owner of the

1 watercraft and shall be accompanied by a fee as follows:
2    A. Class A (all canoes, kayaks, and
3non-motorized paddle boats).$8.50 $6
4    B. Class 1 (all watercraft less
5than 16 feet in length, except
6canoes, kayaks, and non-motorized paddle boats)...$25 $15
7    C. Class 2 (all watercraft 16
8feet or more but less than 26 feet in length
9except canoes, kayaks, and non-motorized paddle

11    D. Class 3 (all watercraft 26 feet or more
12but less than 40 feet in length)..................$100 $75
13    E. Class 4 (all watercraft 40 feet in length

15     Upon receipt of the application in approved form, and when
16 satisfied that no tax imposed pursuant to the "Municipal Use
17 Tax Act" or the "County Use Tax Act" is owed, or that such tax
18 has been paid, the Department shall enter the same upon the
19 records of its office and issue to the applicant a certificate
20 of number stating the number awarded to the watercraft and the
21 name and address of the owner.
22     For the fee paid for each application under this Section,
23 each transfer-renewal under Section 3-5, and each renewal under
24 Section 3-9, 90% of the fee shall be deposited into the
25 Maritime and Underwater Rescue Teams Fund, a special fund that
26 is created in the State treasury. Moneys in the Maritime and

1 Underwater Rescue Teams Fund shall be used, subject to
2 appropriation, for the purpose of establishing, training,
3 equipping, and operating maritime and underwater rescue teams
4 in fire departments and other government-sponsored rescue
5 organizations throughout the State. The remaining 10% shall be
6 deposited into the State Boating Act Fund and shall be used by
7 the Department of Natural Resources, subject to appropriation,
8 for operational expenses in administering the Act.

11     Sec. 10-1. Special fund. All revenue received under the
12 provisions of this Act, including registration fees, fines, or
13 other income of any kind or nature, shall be deposited in the
14 State Treasury and shall be set apart in a special fund to be
15 known as the State Boating Act Fund, except as otherwise
16 provided in Section 3-2 and except that revenue from fines
17 resulting from citations written by a county sheriff or his
18 deputy shall be deposited in a county fund in the county where
19 the citation was written. Appropriations from the State Boating
20 Act Fund, excepting those revenues received as a result of the
21 Snowmobile Registration and Safety Act, shall be made to the
22 Department, and shall be used for the expenses of the
23 Department in administering the registration, boat safety,
24 boat safety education, and enforcement provisions of this Act
25 or for any purpose related or incident thereto and connected

1 therewith, including the construction and improvement of
2 boating facilities, such as access areas, launching sites,
3 harbor facilities, lakes, and marinas, including plans and
4 specifications, engineering surveys, and supervision and land
5 acquisition where necessary. In addition to the foregoing,
6 appropriations from the State Boating Act Fund, other than
7 revenues received as a result of the Snowmobile Registration
8 and Safety Act, may be made to the Department of Natural
9 Resources to pay operational expenses for recreational boating
10 facilities at McHenry Lock and Dam in McHenry County and
11 Sinnissippi Dam in Whiteside County.
