AMENDMENT TO SENATE BILL 349

2     AMENDMENT NO. ______. Amend Senate Bill 349 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the Jobs
5 for Guns Act.
 
6     Section 5. Definitions. For the purposes of this Act:
7     "Gun" means firearm and has the meanings ascribed to it in
8 Section 1.1 of the Firearm Owners Identification Card Act.
9     "Gun buy back program" means any gun trade-in program
10 authorized, sanctioned, or sponsored by any State or local
11 government entity or not-for-profit organization.
12     "List" means a list of the names and contact information
13 voluntarily provided by participants in a gun buy back program.
 
14     Section 15. Operation; Jobs for Guns Fund.
15     (a) The Jobs for Guns Fund is created as a special fund in

1 the State treasury. The Department of State Police shall make
2 grants from funds appropriated from the Jobs for Guns Fund. The
3 grants may be awarded to and used by State and local
4 governmental entities and not-for-profit organizations for the
5 following purposes:
6         (1) to pay $100 per gun to each participant in a gun
7     buy back program who turns in a minimum of 2 guns;
8         (2) to keep records of the name and contact information
9     of each individual who, of his or her own volition, turns
10     in 2 guns to a gun buy back program and records his or her
11     information on the program's list; and
12         (3) to distribute a program's list to any and all
13     companies, contractors, organizations, or vendors, that as
14     a matter of public record have received funds from the
15     federal American Recovery and Reinvestment Act or the
16     "Illinois Jobs Now! Program" for the purposes of
17     infrastructure construction, as a list of potential
18     employees.
19     (b) The list compiled by any grantee shall not, under any
20 circumstances, be distributed or reproduced in any form or
21 fashion to any law enforcement agency; to any law enforcement
22 representative or official; to any criminal investigatory
23 entity; or to any individual not associated with the gun buy
24 back program. The Department of State Police shall not make any
25 copies or reproductions of the list for any criminal
26 investigation purposes.

1     (c) Grants under this Act shall not be available at any
2 time that the Fund does not have moneys currently available to
3 compensate a gun trade-in.
4     (d) Persons participating in the gun buy back program shall
5 not be prosecuted under Section 24-1, Section 24-1.1, or
6 Section 24-1.7 of the Criminal Code of 1961 and Section 2 of
7 the Firearm Owners Identification Card Act.
8     (e) Persons participating in the gun buy back program who
9 voluntarily put their contact information on the list are still
10 required to undergo any and all job application processes that
11 are obligatory for members of the general public.
 
12     Section 20. Transfer. Notwithstanding any other provision
13 of State law to the contrary and in addition to any other
14 transfers that may be provided for by law, on the effective
15 date of this Act, or as soon as may be practical thereafter,
16 the State Comptroller shall direct the transfer of, and the
17 State Treasurer shall transfer, $1,000,000 from the General
18 Revenue Fund into the Jobs for Guns Fund.
 
19     Section 95. The State Finance Act is amended by adding
20 Section 5.719 as follows:
 
21     (30 ILCS 105/5.719 new)
22     Sec. 5.719. Jobs for Guns Fund.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
