AMENDMENT TO SENATE BILL 1076

2    AMENDMENT NO. ______. Amend Senate Bill 1076 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. "An Act in relation to the transfer of various
5property rights by the State", approved September 25, 1985,
6Public Act 84-974, is amended by changing Section 4-1 as
7follows:
 
8    (P.A. 84-974, Sec. 4-1)
9    Sec. 4-1. The Director of Central Management Services is
10hereby authorized to convey by quitclaim deed the following
11described real estate to the Village of Maryville, Illinois, a
12municipal corporation, for the sum of $1:
13    A tract of land in the Northeast Quarter (NE 1/4) of
14    Section 11, Township 3 North, Range 8 West of the Third
15    Principal Meridian, Madison County, Illinois, described as
16    follows: Beginning at a concrete monument set at the

1    Southwest corner of a tract of land owned by Illinois Power
2    Company, described in Book 2575 on Page 23 in the
3    Recorder's Office of Madison County, said point being
4    608.95 feet southerly of the North Line of the Northeast
5    Quarter (NE 1/4) of Section 11, Township 3 North, Range 8
6    West, and on the easterly right-of-way line of State Route
7    159; thence East a distance of 1077.25 feet to the easterly
8    line of a tract described in Book 1037 on page 596; thence
9    South 2 degrees 40 minutes 40 seconds East along said
10    easterly line a distance of 633.16 feet to an old iron pin
11    on the Southeast corner of last mentioned tract; thence
12    South 89 degrees 56 minutes 20 seconds West a distance of
13    248.44 feet to an old iron pin; thence South 89 degrees 53
14    minutes 10 seconds West a distance of 299.86 feet to the
15    easterly right-of-way of Lange Avenue; thence North 2
16    degrees 52 minutes 50 seconds West along said easterly
17    right-of-way a distance of 17 feet to its intersection with
18    the northerly right-of-way of Division Street, as same
19    appears in Plat Book 10 on Page 24 of Madison County
20    Records; thence South 89 degrees 47 minutes 40 seconds West
21    along said northerly right-of-way a distance of 545.13 feet
22    to the easterly right-of-way of State Route 159; thence
23    North 1 degree 09 minutes 30 seconds West along said
24    right-of-way a distance of 618.42 feet to the point of
25    beginning; containing 15.577 acres; except coal and other
26    minerals and the right to mine and remove same.

1    The Village of Maryville may partition and transfer any
2portion of the described real estate to the Maryville Community
3Library District for public purposes for the sum of $1. Should
4the Maryville Community Library District fail to use the real
5estate transferred by the Village of Maryville for public
6purposes, the property shall revert back to the Village of
7Maryville.
8    The Village of Maryville may sell a portion of the
9described real estate to any individual or entity, provided
10that the Village of Maryville sells the real estate for fair
11market value. Prior to any transfer, the Village of Maryville
12shall obtain 3 appraisals of any real estate to be transferred,
13one of which shall be performed by an appraiser residing in the
14county in which the described real estate is located. The
15average of these 3 appraisals shall represent the fair market
16value of the real estate to be transferred. The tract of land
17is for public purposes and if at anytime the City of Maryville
18should fail to use this land for public purposes, the property
19shall revert to the State of Illinois.

21    Section 99. Effective date. This Act takes effect upon
