AMENDMENT TO SENATE BILL 1843

2    AMENDMENT NO. ______. Amend Senate Bill 1843 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Medical Practice Act of 1987 is amended by
5changing Section 2 as follows:
 
6    (225 ILCS 60/2)  (from Ch. 111, par. 4400-2)
7    (Section scheduled to be repealed on November 30, 2011)
8    Sec. 2. Definitions. For purposes of this Act, the
9following definitions shall have the following meanings,
10except where the context requires otherwise:
11    1. "Act" means the Medical Practice Act of 1987.
12    1.5. "Chiropractic physician" means a person licensed to
13treat human ailments without the use of drugs and without
14operative surgery. Nothing in this Act shall be construed to
15prohibit a chiropractic physician from providing advice
16regarding the use of non-prescription products or from

1administering atmospheric oxygen. Nothing in this Act shall be
2construed to authorize a chiropractic physician to prescribe
3drugs.
4    2. "Department" means the Department of Professional
5Regulation.
6    3. "Director" means the Director of Professional
7Regulation.
8    4. "Disciplinary Action" means revocation, suspension,
9probation, supervision, practice modification, reprimand,
10required education, fines or any other action taken by the
11Department against a person holding a license.
12    5. "Disciplinary Board" means the Medical Disciplinary
13Board.
14    6. "Final Determination" means the governing body's final
15action taken under the procedure followed by a health care
16institution, or professional association or society, against
17any person licensed under the Act in accordance with the bylaws
18or rules and regulations of such health care institution, or
19professional association or society.
20    7. "Fund" means the Medical Disciplinary Fund.
21    8. "Impaired" means the inability to practice medicine with
22reasonable skill and safety due to physical or mental
23disabilities as evidenced by a written determination or written
24consent based on clinical evidence including deterioration
25through the aging process or loss of motor skill, or abuse of
26drugs or alcohol, of sufficient degree to diminish a person's

1ability to deliver competent patient care.
2    9. "Licensing Board" means the Medical Licensing Board.
3    10. "Physician" means a person licensed under the Medical
4Practice Act to practice medicine in all of its branches or a
5chiropractic physician licensed to treat human ailments
6without the use of drugs and without operative surgery.
7    11. "Professional Association" means an association or
8society of persons licensed under this Act, and operating
9within the State of Illinois, including but not limited to,
10medical societies, osteopathic organizations, and chiropractic
11organizations, but this term shall not be deemed to include
12hospital medical staffs.
13    12. "Program of Care, Counseling, or Treatment" means a
14written schedule of organized treatment, care, counseling,
15activities, or education, satisfactory to the Disciplinary
16Board, designed for the purpose of restoring an impaired person
17to a condition whereby the impaired person can practice
18medicine with reasonable skill and safety of a sufficient
19degree to deliver competent patient care.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.".
