AMENDMENT TO SENATE BILL 2879

2    AMENDMENT NO. ______. Amend Senate Bill 2879 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by changing
5Section 22-35 as follows:
 
6    (35 ILCS 200/22-35)
7    Sec. 22-35. Reimbursement of municipality before issuance
8of tax deed.
9    (a) Except in any proceeding in which the tax purchaser is
10a county acting as a trustee for taxing districts as provided
11in Section 21-90, an order for the issuance of a tax deed under
12this Code shall not be entered affecting the title to or
13interest in any property located in a county other than Cook
14County in which a city, village or incorporated town has an
15interest under the police and welfare power by advancements
16made from public funds, until the purchaser or assignee makes

1reimbursement to the city, village or incorporated town of the
2money so advanced or the city, village, or town waives its lien
3on the property for the money so advanced. However, in lieu of
4reimbursement or waiver, the purchaser or his or her assignee
5may make application for and the court shall order that the tax
6purchase be set aside as a sale in error. A filing or
7appearance fee shall not be required of a city, village or
8incorporated town seeking to enforce its claim under this
9Section in a tax deed proceeding.
10    (b) Except in any proceeding in which the tax purchaser is
11a county acting as a trustee for taxing districts as provided
12in Section 21-90, an order for the issuance of a tax deed under
13this Code shall not be entered affecting the title to or
14interest in any property located in Cook County in which a
15governmental agency has an interest under (i) the police and
16welfare power by advancements made from public funds or (ii)
17for the provision of water or sewer services, until the
18purchaser or assignee makes reimbursement to the governmental
19agency of the money so advanced or the governmental agency
20waives its lien on the property for the money so advanced.
21However, in lieu of reimbursement or waiver, the purchaser or
22his or her assignee may make application for and the court
23shall order that the tax purchase be set aside as a sale in
24error. A filing or appearance fee shall not be required of a
25governmental agency seeking to enforce its claim under this
26Section in a tax deed proceeding.

1    For the purposes of this subsection (b), "governmental
2agency" includes the State, a city, a village, an incorporated
3town, and any other unit of local government that provides
4water or sewer services.
