10 ILCS 5/10-5.2 new

     Amends the Election Code. Provides that each petition for nomination shall include an affidavit signed by the candidate, under oath, stating that the petition contains no fewer than the specified minimum number of signatures. Provides that the election authority with whom the petition for nomination would otherwise be filed may not accept for filing any petition for nomination that does not include the affidavit.

1    AN ACT concerning elections.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Election Code is amended  by adding Sections 
57-10.4, 8-8.2, and 10-5.2 as follows:
 
6    (10 ILCS 5/7-10.4 new)
7    Sec. 7-10.4. Petition for nomination; minimum number of 
8signatures. Each petition for nomination shall include an 
9affidavit signed by the candidate, under oath, stating that the 
10petition contains no fewer than the minimum number of 
11signatures specified in Section 7-10. The State Board of 
12Elections and the various election authorities and local 
13election officials with whom the petition for nomination would 
14otherwise be filed may not accept for filing any petition for 
15nomination that does not include the affidavit required under 
16this Section.

18    Sec. 8-8.2. Petition for nomination; minimum number of 
19signatures. Each petition for nomination shall include an 
20affidavit signed by the candidate, under oath, stating that the 
21petition contains no fewer than the minimum number of

1Elections may not accept for filing any petition for nomination 
2that does not include the affidavit required under this 
3Section.
 
4    (10 ILCS 5/10-5.2 new)
5    Sec. 10-5.2. Petition for nomination; minimum number of 
6signatures. Each petition for nomination shall include an 
7affidavit signed by the candidate, under oath, stating that the 
8petition contains no fewer than the minimum number of 
9signatures specified in Section 10-2, 10-3, or 10-3.1, as may 
10be appropriate. The State Board of Elections and the various 
11election authorities and local election officials with whom the 
12petition for nomination would otherwise be filed may not accept 
13for filing any petition for nomination that does not include 
14the affidavit required under this Section.
