AMENDMENT TO HOUSE BILL 75

2    AMENDMENT NO. ______. Amend House Bill 75 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Small Business Contracts Act is amended by
5changing Sections 5 and 10 and by adding Sections 12 and 25 as
6follows:
 
7    (30 ILCS 503/5)
8    Sec. 5. Definitions. For the purposes of this Act, the
9following terms shall have the following definitions:
10    "Small business" means a small business as defined in the
11Illinois Procurement Code.
12    "State contract" means a State contract, as defined in the
13Illinois Procurement Code, funded with State or federal funds,
14whether competitively bid or negotiated.
15    "State official or agency" means a department, officer,
16board, commission, institution, or body politic or corporate of

1the State.
2    "Subcontract" means a subcontract, as defined in the
3Illinois Procurement Code, funded with State or federal funds,
4whether competitively bid or not.

7    Sec. 10. Award of State contracts.
8    (a) Not less than 10% of the total dollar amount of State
9contracts shall be established as a goal to be awarded as a
10contract or subcontract to small businesses.
11    (b) The percentage in subsection (a) relates to the total
12dollar amount of State contracts during each State fiscal year,
13calculated by examining independently each type of contract for
14each State official or agency which lets such contracts.

18year, the chief procurement officers, individually or as a
19group, shall provide presentations at which small businesses
20may learn about the contracting process and how to apply for

1the Illinois Administrative Procedure Act, each chief
2procurement officer may adopt rules to implement and administer
3this Act.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
