SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/12-602.1

    Amends the Vehicle Code. Allows the Department of Transportation to erect and maintain signs prohibiting commercial vehicles from operating an engine braking system that emits excessive noise on interstate highways near residential areas or communities (rather than only near weigh stations adjacent to residential areas or communities).

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 12-602.1 as follows:
 
6    (625 ILCS 5/12-602.1)
7    Sec. 12-602.1. Excessive engine braking noise signs.
8    (a) A county or municipality may post signs that prohibit
9the driver of a commercial vehicle, as defined in Section
101-111.8 of this Code, from operating or actuating any engine
11braking system that emits excessive noise. The Department of
12Transportation may erect and maintain the signs on interstate
13highways near weigh stations that are adjacent to residential
14areas or communities.
15    (b) The sign shall state, "EXCESSIVE ENGINE BRAKING NOISE
16PROHIBITED". The Department of Transportation shall adopt
17rules providing for the erection and placement of these signs.
18    (c) This Section does not apply to the use of an engine
19braking system that has an adequate sound muffling system in
20proper working order that prevents excessive noise.
21    (d) It is a defense to this Section that the driver used an
22engine braking system that emits excessive noise in an
23emergency to avoid a collision with a person or another vehicle

1on the highway.
2    (e) A violation of this Section is an equipment violation
3punishable by a fine of $75.
