2 | AMENDMENT NO. ______. Amend House Bill 183, AS AMENDED, by | ||||||
3 | replacing Section 1-100 with the following: | ||||||
4 | "Section 1-100. Home rule; exception. | ||||||
5 | (a) The regulation and licensing of the carrying of | ||||||
6 | firearms are exclusive powers and functions of the State, | ||||||
7 | except as provided in subsection (b) or (c) of this Section. | ||||||
8 | This Section is a denial and limitation of home rule powers and | ||||||
9 | functions under subsection (h) of Section 6 of Article VII of | ||||||
10 | the Illinois Constitution.

11 | (b) Within 6 months from the effective date of this Act: | ||||||
12 | (1) A home rule unit may adopt a resolution or | ||||||
13 | ordinance prohibiting the carrying of handguns in places or | ||||||
14 | locations within the municipality in addition to the | ||||||
15 | prohibited places or locations provided in Section 1-70 of | ||||||
16 | this Act. | ||||||
17 | (2) A home rule unit contiguous to a municipality with |

1 | a population of more than 2 million may adopt a resolution | ||||||
2 | or ordinance prohibiting the carrying of concealed | ||||||
3 | handguns by persons who do not have an endorsement issued | ||||||
4 | by the municipality with a population of more than 2 | ||||||
5 | million as provided in Section 1-22 of this Act. | ||||||
6 | A home rule unit that chooses to adopt a resolution or | ||||||
7 | ordinance in accordance with this Section must notify the | ||||||
8 | Department within 10 days of its adoption. A home rule unit | ||||||
9 | that amends a resolution or ordinance adopted under paragraph | ||||||
10 | (1) of this subsection (b) after the 6 month period must notify | ||||||
11 | the Department within 10 days of the change. A home rule unit | ||||||
12 | that adopts a resolution or ordinance under paragraph (2) of | ||||||
13 | this subsection (b) may not thereafter amend it. A home rule | ||||||
14 | unit that does not adopt a resolution or ordinance within the 6 | ||||||
15 | month period may not thereafter adopt a resolution or ordinance | ||||||
16 | under either paragraph (1) or (2) of this subsection (b).

17 | (c) A municipality that becomes a home rule unit either by | ||||||
18 | population or referendum after the effective date of this Act | ||||||
19 | may within 6 months of becoming a home rule unit:

20 | (1) May adopt a resolution or ordinance prohibiting the | ||||||
21 | carrying of handguns in place or locations within the | ||||||
22 | municipality in addition to the prohibited places or | ||||||
23 | locations provided in Section 1-70 of this Act and must | ||||||
24 | comply with the notification requirements provided in | ||||||
25 | subsection (b).

26 | (2) If it is contiguous to a municipality with a |

1 | population of more than 2 million, may adopt a resolution | ||||||
2 | or ordinance prohibiting the carrying of concealed | ||||||
3 | handguns by persons who do not have an endorsement issued | ||||||
4 | by the municipality with a population of more than 2 | ||||||
5 | million as provided in Section 1-22 of this Act and must | ||||||
