2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The Criminal Code of 2012 is amended by changing |
5 | | Section 20-2 as follows:
|
6 | | (720 ILCS 5/20-2) (from Ch. 38, par. 20-2)
|
7 | | Sec. 20-2. Possession of explosives or explosive or |
8 | | incendiary devices.
|
9 | | (a) A person commits possession of explosives or
explosive |
10 | | or incendiary devices in violation of this this Section when he |
11 | | or she
possesses, manufactures or transports
any explosive |
12 | | compound, timing or detonating device for use with any |
13 | | explosive
compound or incendiary device
and either intends to |
14 | | use the explosive or device to commit any offense or
knows that |
15 | | another intends to use the explosive or device to commit a
|
16 | | felony.
|
17 | | (b) Sentence.
|
18 | | Possession of explosives or explosive or incendiary |
19 | | devices is a Class 1 felony for which a person, if
sentenced to |
20 | | a term of imprisonment, shall be sentenced to not less than 4
|
21 | | years and not more than 30 years.
|
