1 | AMENDMENT TO HOUSE BILL 825

2 | AMENDMENT NO. ______. Amend House Bill 825 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Criminal Code of 2012 is amended by adding | ||||||
5 | Section 24-4.1 as follows: | ||||||
6 | (720 ILCS 5/24-4.1 new) | ||||||
7 | Sec. 24-4.1. Report of lost or stolen firearms. | ||||||
8 | (a) If a person who possesses or acquires a firearm | ||||||
9 | thereafter loses or misplaces the firearm, or if the firearm is | ||||||
10 | stolen from the person, the person must report the loss or | ||||||
11 | theft to the local law enforcement agency within 72 hours after | ||||||
12 | obtaining knowledge of the loss or theft. | ||||||
13 | (b) A law enforcement agency having jurisdiction shall take | ||||||
14 | a written report and shall as soon as practical enter the | ||||||
15 | firearm's serial number as lost or stolen into the Law | ||||||
16 | Enforcement Agencies Data System (LEADS). |

1 | (c) A person does not commit the offense if: | ||||||
2 | (1) the failure to report is due to an act of God, act | ||||||
3 | of war, or inability of law enforcement to receive the | ||||||
4 | report; | ||||||
5 | (2) the person calls 911 to make the report; | ||||||
6 | (3) the person is hospitalized, in a coma, or is | ||||||
7 | otherwise seriously physically or mentally impaired as to | ||||||
8 | prevent the person from reporting; however, the reporting | ||||||
9 | period is only tolled for the period of the person's | ||||||
10 | hospitalization, coma, or impairment; or | ||||||
11 | (4) the person's designee makes a report if the person | ||||||
12 | is unable to make the report. | ||||||
13 | (d) Sentence. A person who violates this Section is guilty | ||||||
14 | of a petty offense for a first violation. A second or | ||||||
15 | subsequent violation of this Section is a Class A | ||||||
16 | misdemeanor. ".
