1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. Return of real property. Upon the payment of the
5sum of $10 to the State of Illinois, and subject to the
6conditions set forth in Sections 10, 15, and 20 of this Act,
7the Director of Natural Resources is authorized to return the
8land referred to as the Wildlife Prairie State Park including
9that real property that was initially conveyed to the State of
10Illinois from the Forest Park Foundation by a corporate special
11warranty deed executed September 5, 2000 and by a warranty deed
12executed on September 4, 2001, by conveying by quitclaim deed
13all right, title, and interest in and to the following
14described land in Peoria County, Illinois (referred to
15hereafter as "Wildlife Prairie State Park") to the Forest Park
16Foundation, a not-for-profit Illinois corporation (referred to
17hereafter as "Forest Park Foundation"):
 
18    Tract 1: That part of the South Half of the North Half of
19    Section 30, Township 9 North, Range 7 East of the Fourth
20    Principal Meridian, Peoria County, Illinois, lying
21    Southeasterly of the centerline of Old Taylor Road (as it
22    existed prior to 1979) and Southwesterly of a line that is

10    (b) Within 30 calendar days after the effective date of
11this Act, the Department of Natural Resources shall provide the
12Director of the Department of Central Management Services with
13an inventory of all property eligible to be transferred under
14this Section. Within 30 calendar days after the receipt of the
15inventory, the Director of the Department of Central Management
16Services shall determine whether the items in the inventory are
17needed or can be used by a State agency and shall provide his
18or her determination in writing to the Department of Natural
19Resources.
 
20    Section 15. Agreement. Prior to the return by conveyance of
21any real property to the Forest Park Foundation, the Director
22of Natural Resources shall enter into an agreement with the
23Forest Park Foundation and with the Friends of Wildlife Prairie
24State Park, a not-for-profit Illinois corporation, the
25intended subsequent owner or operator of the property to be

1returned to the Forest Park Foundation, that includes, but is
2not limited to, provisions that serve the following purposes:
3        (1) ensuring that the property returned to the Forest

6    preservation, and public park purposes, and the promotion
7    of natural resources, including the propagation of wild
8    plants and flowers and domestic and wild animals; and
9        (2) providing, that lodging, resort, recreational
10    facilities, and other commercial purposes, shall be
11    allowable if, and only if, consistent and in furtherance of
12    the public purpose uses described in item 1 of this
13    Section; and
14        (3) requires the Forest Park Foundation to transfer
15    Wildlife Prairie State Park and all personal property
16    transferred pursuant to Section 10 of this Act to Friends
17    of Wildlife Prairie State Park.
 
18    Section 20. Recording. The Director of Natural Resources
19shall obtain a certified copy of the portion of this Act
20containing the title, enacting clause, the effective date, and
21Section 5 which contains the land description of the property
22to be transferred or otherwise affected under this Act within
2369 days after the execution of the agreement specified in
24Section 15 and, upon receipt of payment required by Section 5,
25shall record the certified document in the recorder's office in

1769 days after the effective date and, upon receipt of payment
18required by the Section 25, shall record the certified document
19in the recorder's office in the county in which the land is
20located.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
