SYNOPSIS AS INTRODUCED:

35 ILCS 5/507DDD new

    Amends the Illinois Income Tax Act. Creates the American Red Cross Support Fund checkoff. Amends the State Finance Act to create the Fund. Provides that moneys in the Fund shall be appropriated to the Illinois Emergency Management Agency for the purpose of making grants to the American Red Cross. Provides that moneys in the Fund are not subject to sweeps or administrative charges or charge-backs. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Sections 5.826 and 6z-98 as follows:
 
6    (30 ILCS 105/5.826 new)
7    Sec. 5.826. The American Red Cross Support Fund.
 
8    (30 ILCS 105/6z-98 new)
9    Sec. 6z-98. The American Red Cross Support Fund; creation.
10The American Red Cross Support Fund is created as a special
11fund in the State treasury. Moneys in the Fund shall be
12appropriated to the Illinois Emergency Management Agency and
13may be used only for the purpose of making grants to the
14American Red Cross. Moneys shall be distributed to American Red
15Cross chapters serving Illinois. Moneys in the Fund are not
16subject to sweeps or administrative charges or charge-backs.
 
17    Section 10. The Illinois Income Tax Act is amended by
18adding Section 507DDD as follows:

20    Sec. 507DDD. The American Red Cross Support Fund checkoff.

1For taxable years ending on or after December 31, 2013, the
2Department shall print, on its standard individual income tax
3form, a provision indicating that, if the taxpayer wishes to
4contribute to the American Red Cross Support Fund, as
5authorized by this amendatory Act of the 98th General Assembly,
6then he or she may do so by stating the amount of the
7contribution (not less than $1) on the return and indicating
8that the contribution will reduce the taxpayer's refund or
9increase the amount of payment to accompany the return. The
10taxpayer's failure to remit any amount of the increased payment
11reduces the contribution accordingly. This Section does not
12apply to any amended return.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
