SYNOPSIS AS INTRODUCED:
 
20 ILCS 3960/3.5 new

    Amends the Illinois Health Facilities Planning Act. Provides that a State agency must notify the Board in writing of any intent to construct, modify, establish, close, or change the service category of any State-run healthcare facility. Requires this notification to include the facility's estimated service capacity, the location of the project, the estimated date the facility is to open, and when the facility becomes licensed. Provides that this Section is repealed five years after the effective date of this Act. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Health Facilities Planning Act is
5amended by adding Section 3.5 as follows:
 
6    (20 ILCS 3960/3.5 new)
7    Sec. 3.5. Facilities maintained or operated by a State
8agency.
9    (a) Except for the requirements set forth in subsection (b)
10of this Section, any construction, modification,
11establishment, change in categories of service, or
12discontinuation of a health care facility funded through an
13appropriation from the General Assembly and maintained or
14operated by a State agency is exempt from the requirements of
15this Act.
16    (b) A State agency must notify the Board in writing of any
17appropriation by the General Assembly for the construction,
18modification, establishment, or change in categories of
19service of a health care facility maintained or operated by the
20State. The State agency must include with the written
21notification the following information: (i) the estimated
22service capacity of the health care facility, (ii) the location
23of the project or the intended location if not identified by

1law, and (iii) the date the health care facility is estimated
2to be opened. The State agency must also notify the Board in
3writing when the facility has been licensed by the Illinois
4Department of Public Health or any other licensing body. The
5State agency shall notify the Board in writing of any intent to
6close the health care facility. The State agency shall submit
7to the Board, on behalf of a health care facility, any annual
8facility questionnaires as described in Section 13 of this Act
9or any requests for information by the Board.
10    (c) This Section is repealed five years after the effective
11date of this amendatory Act of the 98th General Assembly.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
