625 ILCS 5/11-704  from Ch. 95 1/2, par. 11-704

    Amends the Illinois Vehicle Code. Provides that the prohibition on 2 wheeled vehicles passing on the right of another vehicle does not apply to devices propelled by human power.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-704 as follows:
 
6    (625 ILCS 5/11-704)  (from Ch. 95 1/2, par. 11-704)
7    Sec. 11-704. When overtaking on the right is permitted. (a)
8The driver of a vehicle with 3 or more wheels may overtake and
9pass upon the right of another vehicle only under the following
10conditions:
11    1. When the vehicle overtaken is making or about to make a
12left turn;
13    2. Upon a roadway with unobstructed pavement of sufficient
14width for two or more lines of vehicles moving lawfully in the
15direction being traveled by the overtaking vehicle.
16    3. Upon a one-way street, or upon any roadway on which
17traffic is restricted to one direction of movement, where the
18roadway is free from obstructions and of sufficient width for 2
19or more lines of moving vehicles.
20    (b) The driver of a 2 wheeled vehicle may not pass upon the
21right of any other vehicle proceeding in the same direction
22unless the unobstructed pavement to the right of the vehicle
23being passed is of a width of not less than 8 feet. This

1subsection does not apply to devices propelled by human power.
2    (c) The driver of a vehicle may overtake and pass another
3vehicle upon the right only under conditions permitting such
4movement in safety. Such movement shall not be made by driving
5off the roadway.
