AMENDMENT TO HOUSE BILL 3379

2    AMENDMENT NO. ______. Amend House Bill 3379 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Critical Health Problems and Comprehensive
5Health Education Act is amended by changing Section 3 and by
6adding Section 3.10 as follows:
 
7    (105 ILCS 110/3)
8    Sec. 3. Comprehensive Health Education Program. The
9program established under this Act shall include, but not be
10limited to, the following major educational areas as a basis
11for curricula in all elementary and secondary schools in this
12State: human ecology and health, human growth and development,
13the emotional, psychological, physiological, hygienic and
14social responsibilities of family life, including sexual
15abstinence until marriage, prevention and control of disease,
16including instruction in grades 6 through 12 on the prevention,

1transmission and spread of AIDS, age-appropriate sexual abuse
2and assault awareness and prevention education in grades
3pre-kindergarten through 12, public and environmental health,
4consumer health, safety education and disaster survival,
5mental health and illness, personal health habits, alcohol,
6drug use, and abuse including the medical and legal
7ramifications of alcohol, drug, and tobacco use, abuse during
8pregnancy, sexual abstinence until marriage, tobacco,
9nutrition, and dental health. The program shall also provide
10course material and instruction to advise pupils of the
11Abandoned Newborn Infant Protection Act. The program shall
12include information about cancer, including without limitation
13types of cancer, signs and symptoms, risk factors, the
14importance of early prevention and detection, and information
15on where to go for help. Notwithstanding the above educational
16areas, the following areas may also be included as a basis for
17curricula in all elementary and secondary schools in this
18State: basic first aid (including, but not limited to,
19cardiopulmonary resuscitation and the Heimlich maneuver),
20heart disease, diabetes, stroke, the prevention of child abuse,
21neglect, and suicide, and teen dating violence in grades 7 8
22through 12.
23    The school board of each public elementary and secondary
24school in the State shall encourage all teachers and other
25school personnel to acquire, develop, and maintain the
26knowledge and skills necessary to properly administer

1life-saving techniques, including without limitation the
2Heimlich maneuver and rescue breathing. The training shall be
3in accordance with standards of the American Red Cross, the
4American Heart Association, or another nationally recognized
5certifying organization. A school board may use the services of
6non-governmental entities whose personnel have expertise in
7life-saving techniques to instruct teachers and other school
8personnel in these techniques. Each school board is encouraged
9to have in its employ, or on its volunteer staff, at least one
10person who is certified, by the American Red Cross or by
11another qualified certifying agency, as qualified to
12administer first aid and cardiopulmonary resuscitation. In
13addition, each school board is authorized to allocate
14appropriate portions of its institute or inservice days to
15conduct training programs for teachers and other school
16personnel who have expressed an interest in becoming qualified
17to administer emergency first aid or cardiopulmonary
18resuscitation. School boards are urged to encourage their
19teachers and other school personnel who coach school athletic
20programs and other extracurricular school activities to
21acquire, develop, and maintain the knowledge and skills
22necessary to properly administer first aid and cardiopulmonary
23resuscitation in accordance with standards and requirements
24established by the American Red Cross or another qualified
25certifying agency. Subject to appropriation, the State Board of
26Education shall establish and administer a matching grant

1program to pay for half of the cost that a school district
2incurs in training those teachers and other school personnel
3who express an interest in becoming qualified to administer
4cardiopulmonary resuscitation (which training must be in
5accordance with standards of the American Red Cross, the
6American Heart Association, or another nationally recognized
7certifying organization) or in learning how to use an automated
8external defibrillator. A school district that applies for a
9grant must demonstrate that it has funds to pay half of the
10cost of the training for which matching grant money is sought.
11The State Board of Education shall award the grants on a
12first-come, first-serve basis.
13    No pupil shall be required to take or participate in any
14class or course on AIDS or family life instruction if his
15parent or guardian submits written objection thereto, and
16refusal to take or participate in the course or program shall
17not be reason for suspension or expulsion of the pupil.
18    Curricula developed under programs established in
19accordance with this Act in the major educational area of
20alcohol and drug use and abuse shall include classroom
21instruction in grades 5 through 12. The instruction, which
22shall include matters relating to both the physical and legal
23effects and ramifications of drug and substance abuse, shall be
24integrated into existing curricula; and the State Board of
25Education shall develop and make available to all elementary
26and secondary schools in this State instructional materials and

1guidelines which will assist the schools in incorporating the
2instruction into their existing curricula. In addition, school
3districts may offer, as part of existing curricula during the
4school day or as part of an after school program, support
5services and instruction for pupils or pupils whose parent,
6parents, or guardians are chemically dependent.

11    Sec. 3.10. Policy on teen dating violence.
12    (a) As used in this Section:
13    "Dating" or "dating relationship" means an ongoing social
14relationship of a romantic or intimate nature between 2
15persons. "Dating" or "dating relationship" does not include a
16casual relationship or ordinary fraternization between 2
17persons in a business or social context.
18    "Teen dating violence" means either of the following:
19        (1) A pattern of behavior in which a person uses or
20    threatens to use physical, mental, or emotional abuse to
21    control another person who is in a dating relationship with
22    the person, where one or both persons are 13 to 19 years of
23    age.
24        (2) Behavior by which a person uses or threatens to use
25    sexual violence against another person who is in a dating

1    relationship with the person, where one or both persons are
2    13 to 19 years of age.
3    (b) The school board of each public school district in this
4State shall adopt a policy that does all of the following:
5        (1) States that teen dating violence is unacceptable
6    and is prohibited and that each student has the right to a
7    safe learning environment.
8        (2) Incorporates age-appropriate education about teen
9    dating violence into new or existing training programs for
10    students in grades 7 through 12 and school employees, as
11    recommended by the school officials identified under
12    subdivision (4) of this subsection (b).
13        (3) Establishes procedures for the manner in which
14    employees of a school are to respond to incidents of teen
15    dating violence that take place at the school, on school
16    grounds, at school-sponsored activities, or in vehicles
17    used for school-provided transportation.
18        (4) Identifies by job title the school officials who
19    are responsible for receiving reports related to teen
20    dating violence.
21        (5) Notifies students and parents of the teen dating
22    violence policy adopted by the board.
 
23    Section 99. Effective date. This Act takes effect July 1,
242013.".
