AMENDMENT TO HOUSE BILL 3834

2    AMENDMENT NO. ______. Amend House Bill 3834, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Secretary of State Act is amended by
6changing Section 12 as follows:
 
7    (15 ILCS 305/12)  (from Ch. 124, par. 10.2)
8    Sec. 12. Parking fees; leases.
9    (a) The Secretary of State shall impose a fee of $20 per
10month payable by all State employees persons parking vehicles
11in the underground parking facility located south of the
12William G. Stratton State Office Building in Springfield and
13the parking ramp located at 401 South College Street located
14west of the William G. Stratton State Office Building in
15Springfield, unless a non-State employee requests a space
16located in either garage, in which case the Secretary shall set

1the fee by rule. State officers and employees who make
2application for and are allotted parking places in such parking
3facilities shall authorize the Comptroller to deduct the
4required fees from their payroll checks under the State Salary
5and Annuity Withholding Act and the amounts so withheld shall
6be deposited as provided in Section 8 of that Act. Persons who
7are not subject to the State Salary and Annuity Withholding Act
8and who are allotted parking places under this Section shall
9pay the required fees directly to the Office of the Secretary
10of State and the amounts so collected shall be deposited as
11follows: 80% in the Capital Development Bond Retirement and
12Interest Fund in the State Treasury and 20% in the State
13Parking Facility Maintenance Fund in the State Treasury.
14    (b) The Secretary of State may enter into agreements with
15public or private entities or individuals to lease to those
16entities or individuals parking spaces at State-owned
17Secretary of State facilities. Such agreements may be executed
18only upon a determination by the Secretary that leasing the
19parking spaces will not adversely impact the delivery of
20services to the public. The fee to be charged to the entity or
21individual leasing the parking spaces shall be established by
22rule. All funds collected by the Secretary pursuant to such
23leases shall be deposited in the State Parking Facility
24Maintenance Fund and shall be used for the maintenance and
25repair of parking lots at State-owned Secretary of State
26facilities.
