AMENDMENT TO HOUSE BILL 4035

2    AMENDMENT NO. ______. Amend House Bill 4035 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Health Statistics Act is amended
5by changing Section 4 as follows:
 
6    (410 ILCS 520/4)  (from Ch. 111 1/2, par. 5604)
7    Sec. 4. (a) In carrying out the purposes of this Act, the
8Department may:
9        (1) Collect and maintain health data on:
10            (i) The extent, nature, and impact of illness,
11        including factors relating to obesity and disability
12        on the population of the State;
13            (ii) The determinants of health and health hazards
14        including obesity;
15            (iii) Health resources, including the extent of
16        available manpower and resources;

1            (iv) Utilization of health care;
2            (v) Health care costs and financing; and
3            (vi) Other health or health-related matters; and .
4            (vii) The connection between the long-term effects
5        of childhood cancer and the original cancer diagnosis
6        and treatment.
7        (2) Undertake and support research, demonstrations,
8    and evaluations respecting new or improved methods for
9    obtaining current data on the matters referred to in
10    subparagraph (1).
11    (b) The Department may collect health data under authority
12granted by any unit of local government and on behalf of other
13governmental or not-for-profit organizations, including data
14collected by local schools and the State Board of Education
15relating to obesity on the health examination form required
16pursuant to Section 27-8.1 of the School Code. The data shall
17be de-identified and aggregated pursuant to rules promulgated
18by the Department to prevent disclosure of personal identifying
19information.
20    (c) The Department shall collect data only on a voluntary
21basis from individuals and organizations, except when there is
22specific legal authority to compel the mandatory reporting of
23the health data so requested. In making any collection of
24health data from an individual or organization the Department
25must give to such individual or organization a written
26statement which states:

1        (1) Whether the individual or organization is required
2    to respond, and any sanctions for noncompliance;
3        (2) The purposes for which the health data are being
4    collected; and
5        (3) In the case of any disclosure of identifiable
6    health data for other than research and statistical
7    purposes, the items to be disclosed, to whom the data are
8    to be disclosed and the purposes for which the data are to
9    be disclosed.
10    (d) Except as provided in Section 5, no health data
11obtained in the course of activities undertaken or supported
12under this Act may be used for any purpose other than the
13purpose for which they were supplied or for which the
14individual or organization described in the data has otherwise
15consented.
16    (e) The Department shall take such actions as may be
17necessary to assure that statistics developed under this Act
18are of high quality, timely, comprehensive, as well as
19specific, standardized and adequately analyzed and indexed.
20    (f) The Department shall take such action as is appropriate
21to effect the coordination of health data activities, including
22health data specifically relating to obesity collected
23pursuant to Section 27-8.1 of the School Code, within the State
24to eliminate unnecessary duplication of data collection and
25maximize the usefulness of data collected.
26    (g) The Department shall (1) participate with state, local

1and federal agencies in the design and implementation of a
2cooperative system for producing comparable and uniform health
3information and statistics at the federal, state, and local
4levels; and (2) undertake and support research, development,
5demonstrations, and evaluations respecting such cooperative
6system.
