AMENDMENT TO HOUSE BILL 4612

2    AMENDMENT NO. ______. Amend House Bill 4612 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
529-20 as follows:
 
6    (105 ILCS 5/29-20 new)
7    Sec. 29-20. Transportation for school districts with
8shared service agreements. The State Board of Education shall
9create a pilot program allowing school districts to achieve
10savings through shared service agreements in providing
11transportation to students. This pilot program shall begin on
12January 1, 2015 and expire on January 1, 2018. Under the pilot
13program, any 2 or more school districts that share one or more
14boundaries may combine transportation activities to, in
15addition to the variety of economic, environmental, and traffic
16safety benefits, achieve savings to these school districts as

1well as this State. Any shared service agreement entered into
2for the purposes of this Section must be reduced to writing and
3forwarded to the State Board of Education prior to the
4effective date of that agreement. For any school districts
5electing to combine such transportation, the State Board of
6Education shall reimburse the school districts in an amount in
7addition to any other transportation reimbursement or other
8moneys owed to the school districts. In calculating this
9reimbursement, the State Board of Education shall reimburse
10school districts in the year following the year in which
11savings were achieved in an amount deemed equal to 50% of the
12actual or estimated savings achieved by this State from any
13reductions in other reimbursement the consolidation achieved.
14This additional reimbursement must be divided between or among
15the school districts by a percentage equal to the percentage of
16the total student population made up by each district's
17population. School districts may jointly enter into any
18contract not otherwise prohibited by this Article with other
19school districts or transportation providers to achieve these
20savings. In applying for reimbursement under this Section,
21school districts shall use forms prescribed by the State Board
22of Education, accompanied by any information requested by the
23State Board of Education or deemed useful by the school
24districts, including historic transportation information,
25mileage reductions, or information provided by vendors or
26consultants. School districts may enter into these shared

1service agreements for any period of time otherwise allowed by
2law, but in no case may they receive moneys under this Section
3on or after January 1, 2018. In estimating savings for multiple
4years under this Section, the State Board of Education shall
5estimate savings in each year achieved by the school districts;
6however, the final amount transferred under this Section may be
7changed in any year to reflect actual savings, and amounts may
8be reduced in a year if the previous year's moneys were
9transferred based on estimates that were not realized in that
10year.
 
11    Section 99. Effective date. This Act takes effect July 1,
122014.".
