2 | AMENDMENT NO. ______. Amend House Bill 4754, AS AMENDED, by | ||||||
3 | replacing everything after the enacting clause with the | ||||||
4 | following:
| ||||||
5 | "Section 5. The Criminal Code of 2012 is amended by adding | ||||||
6 | Section 24-2.3 as follows: | ||||||
7 | (720 ILCS 5/24-2.3 new) | ||||||
8 | Sec. 24-2.3. Unlawful use of a three-dimensional printer to
| ||||||
9 | create a firearm. | ||||||
10 | (a) As used in this Section, "three-dimensional printer"
| ||||||
11 | means a computer-driven machine capable of producing a
| ||||||
12 | three-dimensional object from a digital model. | ||||||
13 | (b) A person commits unlawful use of a three-dimensional
| ||||||
14 | printer to create a firearm when he or she knowingly uses a
| ||||||
15 | three-dimensional printer to create a fully functioning | ||||||
16 | firearm.
This subsection (b) does not apply to: |

1 | (1) a person who possesses a license to manufacture | ||||||
2 | firearms under subsection (a) of Section 923 of the federal | ||||||
3 | Gun Control Act of 1968 (18 U.S.C. 923(a)); or | ||||||
4 | (2) a person who uses a three-dimensional printer to | ||||||
5 | create a non-functioning prototype of a firearm. | ||||||
6 | (c) Sentence. Unlawful use of a three-dimensional printer
| ||||||
7 | to create a firearm is a Class A misdemeanor. ".
