AMENDMENT TO HOUSE BILL 4781

2    AMENDMENT NO. ______. Amend House Bill 4781 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Unified Code of Corrections is amended by
5changing Section 3-7-2 as follows:
 
6    (730 ILCS 5/3-7-2)  (from Ch. 38, par. 1003-7-2)
7    Sec. 3-7-2. Facilities.
8    (a) All institutions and facilities of the Department shall
9provide every committed person with access to toilet
10facilities, barber facilities, bathing facilities at least
11once each week, a library of legal materials and published
12materials including newspapers and magazines approved by the
13Director. A committed person may not receive any materials that
14the Director deems pornographic.
15    (b) (Blank).
16    (c) All institutions and facilities of the Department shall

1provide facilities for every committed person to leave his cell
2for at least one hour each day unless the chief administrative
3officer determines that it would be harmful or dangerous to the
4security or safety of the institution or facility.
5    (d) All institutions and facilities of the Department shall
6provide every committed person with a wholesome and nutritional
7diet at regularly scheduled hours, drinking water, clothing
8adequate for the season, bedding, soap and towels and medical
9and dental care.
10    (e) All institutions and facilities of the Department shall
11permit every committed person to send and receive an unlimited
12number of uncensored letters, provided, however, that the
13Director may order that mail be inspected and read for reasons
14of the security, safety or morale of the institution or
15facility.
16    (f) All of the institutions and facilities of the
17Department of Corrections and the Department of Juvenile
18Justice shall permit every committed person to receive
19visitors, except in case of abuse of the visiting privilege or
20when the chief administrative officer determines that such
21visiting would be harmful or dangerous to the security, safety
22or morale of the institution or facility. The chief
23administrative officer shall have the right to restrict
24visitation to non-contact visits for reasons of safety,
25security, and order, including, but not limited to, restricting
26contact visits for committed persons engaged in gang activity.

1No committed person in a Department of Corrections super
2maximum security facility or on disciplinary segregation is
3allowed contact visits. Any committed person in the Department
4of Corrections found in possession of illegal drugs or who
5fails a drug test shall not be permitted contact visits for a
6period of at least 6 months. Any committed person in the
7Department of Corrections involved in gang activities or found
8guilty of assault committed against a Department employee shall
9not be permitted contact visits for a period of at least 6
10months. The Department shall offer every visitor appropriate
11written information concerning HIV and AIDS, including
12information concerning how to contact the Illinois Department
13of Public Health for counseling information. The Department
14shall develop the written materials in consultation with the
15Department of Public Health. The Department shall ensure that
16all such information and materials are culturally sensitive and
17reflect cultural diversity as appropriate. Implementation of
18the changes made to this Section by this amendatory Act of the
1994th General Assembly is subject to appropriation.
20    (f-5) The Department shall establish a pilot program in one
21or more institutions or facilities of the Department to permit
22committed persons to remotely visit family members through
23interactive video conferences. The Department may enter into
24agreements with third-party organizations to provide video
25conference facilities for family members of committed persons.
26The Department may determine who is a family member eligible to

1participate in the program and the conditions in which and
2times when the video conferences may be conducted. The
3Department may conduct such conferences as an alternative to
4transporting committed persons to facilities and institutions
5of the Department near the residences of family members of the
6committed persons.
7    Beginning on October 1, 2010 and through October 1, 2012,
8the Department shall issue an annual report to the General
9Assembly regarding the implementation and effectiveness of the
10pilot program created by this subsection (f-5).
11    (g) All institutions and facilities of the Department shall
12permit religious ministrations and sacraments to be available
13to every committed person, but attendance at religious services
14shall not be required.
15    (h) Within 90 days after December 31, 1996, the Department
16shall prohibit the use of curtains, cell-coverings, or any
17other matter or object that obstructs or otherwise impairs the
18line of vision into a committed person's cell.
