1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Natural Resources Restoration Trust Fund Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Department" means the Department of Natural Resources.
8    "Director" means the Director of Natural Resources.
9    "Fund" means the Natural Resources Restoration Trust Fund
10created in Section 10 of this Act.
 
11    Section 10. The Natural Resources Restoration Trust Fund.
12    (a) There is hereby created in the State treasury the
13Natural Resources Restoration Trust Fund to receive deposits of
14moneys available from or intended for the investigation,
15assessment, restoration, or replacement of injured or damaged
16natural resources resulting from claims pursued under the laws
17of the United States, this State, or other statutory or common
18law. The fund may receive deposits of moneys made available
19from any other source. All moneys in the fund are to be
20invested and reinvested by the State Treasurer. All interest
21accruing from these investments shall be deposited in the fund.
22Moneys received through settlement or litigation of claims for

1injured natural resources and directed at the restoration,
2rehabilitation, replacement, or the acquisition of the
3equivalent of injured natural resources and the benefits they
4provide, shall be available for those uses until the funds are
5expended.
6    (b) All moneys deposited into the fund shall be used by the
7Department of Natural Resources to:
8        (1) Take necessary or appropriate action to
9    investigate and assess the nature and extent of injuries or
10    damage to Illinois natural resources and the benefits they
11    provide.
12        (2) Take necessary or appropriate action to restore,
13    rehabilitate, replace, or acquire the equivalent of
14    injured or damaged natural resources and the benefits they
15    provide.
16        (3) Meet any requirements which must be met by the
17    State in order to obtain federal funds, or any other funds,
18    to address injury or damage to natural resources.
19        (4) Pay for the cost of Department personnel,
20    contractual, professional, or technical services to review
21    or perform natural resource injury or damage assessments,
22    natural resource restoration or replacement actions,
23    environmental or ecological risk assessments,
24    environmental impact assessment actions, or other
25    activities related to environmental contamination of real
26    property.

1        (5) Administer the provisions of this Section.
2    (c) The General Assembly shall annually appropriate to the
3fund such amounts as it deems necessary to fulfill the purposes
4of this Section.
5    (d) The Department may accept, receive, and administer on
6behalf of the State any moneys made available to the State from
7any source for the purposes set forth in this Section. These
8moneys may be in addition to any other funds otherwise
9appropriated to the Department for similar purposes. Interest
10or income earned on moneys deposited into the fund shall be
11retained in the fund to be used by the Department pursuant to
12the provisions of this Section.
 
13    Section 900. The State Finance Act is amended by adding
14Section 5.855 as follows:
 
15    (30 ILCS 105/5.855 new)
16    Sec. 5.855. The Natural Resources Restoration Trust Fund.
 
17    Section 999. Effective date. This Act takes effect upon
18becoming law.
