1 | AMENDMENT TO SENATE BILL 3018

2 | AMENDMENT NO. ______. Amend Senate Bill 3018 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Criminal Code of 2012 is amended by adding | ||||||
5 | Section 24-2.3 as follows: | ||||||
6 | (720 ILCS 5/24-2.3 new) | ||||||
7 | Sec. 24-2.3. Unlawful use of a three-dimensional printer to
| ||||||
8 | create a firearm. | ||||||
9 | (a) As used in this Section, "three-dimensional printer"
| ||||||
10 | means a computer-driven machine capable of producing a
| ||||||
11 | three-dimensional object from a digital model. | ||||||
12 | (b) A person commits unlawful use of a three-dimensional
| ||||||
13 | printer to create a firearm when he or she knowingly uses a
| ||||||
14 | three-dimensional printer to create a fully functioning | ||||||
15 | firearm.
This subsection (b) does not apply to: | ||||||
16 | (1) a person who possesses a license to manufacture |

| |||||||
1 | firearms under subsection (a) of Section 923 of the federal | ||||||
2 | Gun Control Act of 1968 (18 U.S.C. 923(a)); or | ||||||
3 | (2) a person who uses a three-dimensional printer to | ||||||
4 | create a non-functioning prototype of a firearm. | ||||||
5 | (c) Sentence. Unlawful use of a three-dimensional printer
| ||||||
6 | to create a firearm is a Class A misdemeanor. ".
