Amends the Criminal Code of 2012. Creates the offense of possession of explosive substances. Provides that a person commits the offense when he or she knowingly
possesses triacetone triperoxide (TATP) or hexamethylene
triperoxide diamine (HMTD). Provides that a violation is a Class 4 felony. Provides exemptions.

1 | | AN ACT concerning criminal law.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Criminal Code of 2012 is amended by adding |
5 | | Section 24-2.3 as follows: |
6 | | (720 ILCS 5/24-2.3 new) |
7 | | Sec. 24-2.3. Possession of explosive substances. |
8 | | (a) A person commits possession of explosive substances |
9 | | when he or she knowingly
possesses triacetone triperoxide |
10 | | (TATP) or hexamethylene
triperoxide diamine (HMTD). |
11 | | (b) Nothing in this Section prohibits: |
12 | | (1) the authorized manufacture, transportation, |
13 | | distribution, use, or possession of any
material, |
14 | | substance, or device by a member of the armed forces of the |
15 | | United States, fire
fighters, or law enforcement officers; |
16 | | (2) the manufacture, transportation, distribution, |
17 | | use, or possession of any material,
substance, or device to |
18 | | be used solely for scientific research, educational |
19 | | purposes, or for
any lawful purpose, subject to the |
20 | | provisions of Chapter 425 of the Illinois Compiled
|
21 | | Statutes; or |
22 | | (3) the lawful manufacture of ammunition by a person |
23 | | for his or her own lawful use. |
