1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||
4 | Section 5. The Illinois Highway Code is amended by changing | |||||||||||||||||||||
5 | Sections 4-220 and 4-405 as follows: | |||||||||||||||||||||
6 | (605 ILCS 5/4-220) | |||||||||||||||||||||
7 | Sec. 4-220. Bicycle and pedestrian ways. | |||||||||||||||||||||
8 | (a) Bicycle and pedestrian ways shall be given full | |||||||||||||||||||||
9 | consideration in the planning and development of | |||||||||||||||||||||
10 | transportation facilities, including the incorporation of such | |||||||||||||||||||||
11 | ways into State plans and programs. | |||||||||||||||||||||
12 | (b) In or within one mile of an urban area, bicycle and | |||||||||||||||||||||
13 | pedestrian ways shall be established in conjunction with the | |||||||||||||||||||||
14 | construction, reconstruction, or other change of any State | |||||||||||||||||||||
15 | transportation facility except: | |||||||||||||||||||||
16 | (1) in pavement resurfacing projects that do not widen | |||||||||||||||||||||
17 | the existing traveled way or do not provide stabilized | |||||||||||||||||||||
18 | shoulders; or | |||||||||||||||||||||
19 | (2) where approved by the Secretary of Transportation | |||||||||||||||||||||
20 | based upon documented safety issues, excessive cost or | |||||||||||||||||||||
21 | absence of need. | |||||||||||||||||||||
22 | (c) Bicycle and pedestrian ways may be included in pavement | |||||||||||||||||||||
23 | resurfacing projects when local support is evident or bicycling |

1 | and walking accommodations can be added within the overall | ||||||
2 | scope of the original roadwork. | ||||||
3 | (d) The Department shall establish design and construction | ||||||
4 | standards for bicycle and pedestrian ways.
Beginning July 1, | ||||||
5 | 2007, this Section shall apply to planning and training | ||||||
6 | purposes only. Beginning July 1, 2008, this Section shall apply | ||||||
7 | to construction projects.

8 | (e) The Department shall comply with the Department's IDOT | ||||||
9 | ADA transition plan while executing any of the projects within | ||||||
10 | this Section. | ||||||

| ||||||
14 | The Department shall maintain all highways in the State | ||||||
15 | highway system
either with its own forces or pursuant to an | ||||||
16 | agreement or contract entered
into pursuant to this Code.

17 | In the course of its other maintenance work, the Department | ||||||
18 | shall paint
and maintain a line not less than 2 1/2 inches in | ||||||
19 | width on the edges of
uncurbed roadways of all State highways | ||||||
20 | having an Illinois or U.S. route
traffic marking and which | ||||||
21 | carry an average daily traffic of more than 1000
vehicles. The | ||||||
22 | Department may paint and maintain such lines on such other
| ||||||
23 | State highways as it deems desirable.

24 | In the course of its maintenance work, including the | ||||||
25 | resurfacing or the reconstructing of State highways, the |

1 | Department shall comply with the Department's IDOT ADA | ||||||
2 | transition plan with regard to bicycle and pedestrian ways. | ||||||
