Synopsis As Introduced
Amends the Environmental Protection Act. Makes a technical change in a Section concerning the short title.

Senate Committee Amendment No. 1

Replaces everything after the enacting clause. Amends the Environmental Protection Act. Provides that no person shall produce, manufacture, sell, or offer for sale any personal cosmetic product that contains intentionally-added microbeads. Provides that any violation of this provision is a business offense punishable by a fine not to exceed $2,500 for each day during which the violation continues, and the person committing the violation may be enjoined from continuing the violation. Provides that, for a second or subsequent violation, the fine may not exceed $5,000 for each day during which the violation continues. Provides that a home rule unit may not regulate the sale of products containing microbeads. Effective on December 31, 2015.

Senate Floor Amendment No. 2
Adds reference to:
415 ILCS 5/42from Ch. 111 1/2, par. 1042

Replaces everything after the enacting clause. Amends the Environmental Protection Act. Reinserts the provisions of the bill, as amended by Senate Amendment No. 1, except with the following changes: (1) changes the effective date to December 31, 2017 (instead of December 31, 2015); (2) provides additional legislative findings concerning synthetic plastic microbeads and their effect on the environment; (3) defines "synthetic plastic microbead", "plastic", and "personal care product"; (4) provides that effective December 31, 2017 (instead of December 31, 2015), no person shall manufacture for sale (instead of produce, manufacture, sell, or offer for sale) a personal care product (instead of personal cosmetic product) that contains synthetic plastic microbeads (instead of intentionally-added microbeads); (5) provides that effective December 31, 2018, no person shall accept for sale a personal care product that contains synthetic plastic microbeads; (6) removes a provision concerning fines for a violation of the prohibition; (7) removes a provision that a person may be enjoined from continuing a violation of the prohibition; (8) provides for a civil penalty of up to $1,000 for the first violation of the prohibition and a civil penalty of up to $2,500 for a second or subsequent violation of the prohibition; and (9) removes a provision that provides that a home rule unit may not regulate the sale of microbeads.

House Floor Amendment No. 2
Removes a provision excluding over the counter drugs from the definition of "personal care product". Defines "over the counter drug". Provides that effective December 31, 2018, no person shall manufacture for sale an over the counter drug that contains synthetic plastic microbeads. Provides that effective December 31, 2019, no person shall accept for sale an over the counter drug that contains synthetic plastic microbeads.
