Synopsis As Introduced
Amends the Illinois Pension Code. Provides that if a member or participant of a retirement system or pension fund subject to this Code is receiving a retirement annuity or retirement pension under that system or fund and becomes a member or participant of any other system or fund created by this Code and is employed on a full-time basis, then the person's retirement annuity or retirement pension under that system or fund shall be suspended during that employment. Effective July 1, 2011.

Replaces everything after the enacting clause. Amends the Downstate Teachers Article of the Illinois Pension Code. Specifies that a provision authorizing annuitants to return to service must not be construed to authorize multiple annuitants, without impairing their retirement status, to accept employment with a school district or other employer in order to fill, as a group, a teaching position that would ordinarily be occupied by an active participant. Provides that if a school board or other employer determines there is a subject or administrative shortage, then it must apply for an exemption under a specific provision of the Code. Effective immediately.

Replaces everything after the enacting clause. Amends the School Code. Prohibits a school board from hiring multiple people who are retired and are receiving a retirement annuity under the Teachers' Retirement System of the State of Illinois in order to fill, as a group, a teaching position that would ordinarily be occupied by a single, full-time teacher. Provides that this prohibition does not apply if the school board determines that there is a subject or administrative position shortage that would require action, in which case the school board must apply for an exemption under a Section of the Illinois Pension Code in relation to returning to teaching in a subject shortage area.

Amends the State Employees Article of the Illinois Pension Code. Provides that an annuitant who accepts temporary employment from a department for total compensation of less than $30,000 during a calendar year is not considered to make a re-entry after retirement.
