Synopsis As Introduced
Amends the School Code. Requires the State Board of Education to adopt rules for the elimination of vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2009 and for the elimination of all foods containing trans fats from public schools beginning on July 1, 2010. Effective immediately.

Senate Floor Amendment No. 1
Removes the definition of "trans fats". Provides instead that "trans fat" means fat that is considered trans fat by the U.S. Food and Drug Administration. Provides that "trans fat" does not include naturally occurring trans fat. Provides that food shall be deemed to contain trans fat if the food is labeled as, lists as an ingredient, or contains any kind of partially hydrogenated vegetable oil. Provides, however, that food shall not be deemed to contain trans fat if the food contains less than 0.5 grams of trans fat per serving.

House Floor Amendment No. 2
Requires the State Board of Education to ban (instead of adopt rules for the elimination of) vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2009 and ban (instead of adopt rules for the elimination of) all foods containing trans fats from public schools beginning on July 1, 2010. Imposes conditions on any rulemaking authority. Removes the effective date provision.
