Synopsis As Introduced
Amends the State Fire Marshal Act. Allows the Office of the State Fire Marshal to create an equipment exchange program under which fire departments and fire protection districts can donate equipment to the State Fire Marshal which the Marshal can re-certify as safe and distribute to other departments and districts. Limits the liability of fire departments and fire protection districts that donate equipment. Effective immediately.

House Committee Amendment No. 1
Provides that township fire departments may participate in the equipment exchange program. Limits the liability for township fire departments that participate in the exchange program.

House Floor Amendment No. 2
Deletes everything. Amends the State Fire Marshal Act. Allows the Office of the State Fire Marshal to create an equipment exchange program under which fire departments, fire protection districts, and township fire departments can donate equipment to each other. Provides that the donor of the fire protection equipment is not liable for damage or injury caused by the donated equipment, with limited exception, if the donor makes certain written disclosures. Provides that the recipient of the fire protection equipment is not relieved of any liability for damage or injury caused by donated fire equipment it received. Effective immediately.
