House Committee Amendment No. 1
Adds reference to:
330 ILCS 60/6from Ch. 126 1/2, par. 34

Replaces everything after the enacting clause. Reinserts similar provisions, but with the following changes: Makes an employer's knowing violation of the Service Member's Employment Tenure Act a civil rights violation under the Illinois Human Rights Act. Removes a provision granting the circuit courts, upon the filing of a complaint by a person entitled to the benefits of the Act, the power to require an employer to comply with the Act's requirements and to compensate the complainant for any loss of wages or benefits suffered by reason of such employer's unlawful action, together with reasonable attorney's fees and costs. Removes language requiring the Attorney General to establish and maintain a statewide toll-free hotline to provide information and referrals to employees or other individuals concerning their rights under the Act. Effective immediately.

Senate Floor Amendment No. 1
Replaces everything after the enacting clause. Reinserts the engrossed bill with the following changes: Provides that an employer's knowing violation of the Service Member's Employment Tenure Act is a Class A misdemeanor with a mandatory minimum fine of not less than $5,000 and a maximum fine of $10,000 (rather than a business offense punishable by a fine of not less than $5,000 and not more than $10,000). Removes language providing that an employer's knowing violation of the Act is a civil rights violation under the Illinois Human Rights Act. Restores a provision granting the circuit courts, upon the filing of a complaint by a person entitled to the benefits of the Act, the power to require an employer to comply with the Act's requirements and to compensate the complainant for any loss of wages or benefits suffered by reason of such employer's unlawful action, together with reasonable attorney's fees and costs. Effective immediately.
